Consultation on the SEAC draft opinion
on PFAS restriction - outcome
3 511 comments from more than 3 200 organisations and 250
individuals were submitted during the 60-day consultation on the
draft opinion of ECHA’s Committee for Socio-Economic Analysis
(SEAC). SEAC is now assessing the contributions and is expected to
adopt its final opinion on the proposed restriction of per- and
polyfluoroalkyl substances (PFAS) by the end of 2026.
The consultation on the SEAC draft opinion, which ran from 26 March to 25 May 2026,
attracted strong engagement from stakeholders across industry, civil society, academia
and public authorities.

The consultation was structured into different surveys. One on the general part the
opinion, one for PFAS manufacturing and 14 others for specific sectors evaluated by
SEAC.

Contributions focused on the socio-economic impacts of the proposed restriction,
including availability of alternatives, transition periods, cost implications and potential
impacts on competitiveness.
SEAC is now assessing the submissions. Comments providing relevant, evidence-based
socio-economic information are being assessed to confirm or modify the Committee’s
conclusions presented in the draft opinion.
Next steps
The contributions received during the consultation have already been published on
ECHA’s website. Information marked as confidential by consultees is not made public
The Committee is expected to adopt its final opinion by the end of 2026. This adoption
will conclude ECHA’s Committees’ scientific evaluation of the proposed restriction and the
opinions will be formally submitted to the European Commission.
Based on the two final opinions, the Commission will propose a restriction for discussion
and vote in the REACH Committee, composed of EU Member States.
Background
The restriction proposal was prepared by authorities in Denmark, Germany, the
Netherlands, Norway and Sweden. It was submitted to ECHA on 13 January 2023 and
aims to reduce PFAS emissions into the environment and make products and processes
safer for people. The six-month consultation on the proposal ran from 22 March to 25
September 2023.
ECHA’s Committee for Risk Assessment (RAC) adopted its final opinion on 2 March, while
SEAC agreed its draft opinion, subject to an additional 60-day consultation, on 10 March
2026.

Die Europäische Chemikalienagentur (ECHA) hatte eine öffentliche Konsultation zum Entwurf der SEAC Stellungnahme zur geplanten PFAS Beschränkung durchgeführt. Interessengruppen waren eingeladen, Rückmeldungen zu sozioökonomischen Auswirkungen sowie zur Verfügbarkeit und Umsetzbarkeit von Alternativen einzubringen. Pharma Deutschland hat ebenfalls an der Konsultation teilgenommen und die Perspektive der Mitgliedsunternehmen eingebracht. Die ECHA hat jetzt erste Ergebnisse veröffentlicht: Es wurden 3 511 Stellungnahmen von mehr als 3 200 Organisationen und 250 Einzelpersonen eingereicht. Die Stellungnahmen konzentrierten sich auf die sozioökonomischen Auswirkungen der vorgeschlagenen Beschränkung, einschließlich der Verfügbarkeit von Alternativen, Übergangsfristen, Kostenauswirkungen und potenzieller Auswirkungen auf die Wettbewerbsfähigkeit. Der SEAC prüft derzeit die eingegangenen Stellungnahmen. RAMP UP Data Strategy Note
The purpose of this note is to provide an outline of the type of data DG HERA will be asking prospective RAMP UP members to provide and to describe the phased approach that these data requests will follow. DG HERA will treat confidential information shared in accordance with the applicable legal framework, including on access to documents and EU competition rules. Sensitive data will be shared exclusively with DG HERA in line with the notice on handling of confidential information and the RAMP UP terms and conditions principles.
1. Registration
The first data exchange will happen at registration in the Stakeholder Hub which is common to all users. When creating a profile, a user will provide personal contact information (name, function, email, phone number) as well as information about the organisation they are representing (organisation name, address of headquarters, transparency register and VAT number, organisation type, association and website).
2. Member application
After registration, applicants can fill out an application form in the Stakeholder Hub in order to demonstrate their relevance for the objective of RAMP UP in ensuring access to and availability of crisis-relevant MCMs. At the same time this application will be the basis to assess on a case-by-case basis whether the applicant meets the eligibility criteria. These criteria will help DG HERA to assess if applicants are supply chain actors with proven relevance in ensuring access to and availability of crisis-relevant MCMs, if compliance with confidentiality and applicable law is respected and if financial & legal standard criteria are being met.
3. Additional information (in support of the application)
Data collection will focus on the following data clusters*
Once an application has been admitted, the member will be asked to provide additional information. This information will not be used for inclusion or exclusion purposes but will be crucial to for the operation of the RAMP UP initiative and to better assess the coverage of MCMs within the RAMP-UP membership, to map, where relevant, production capacity scale-up and to identify potential gaps requiring engagement with additional sectors.

Phased approach of data collection
When it comes to medicinal product MCMs, data collection foresees a phased approach which will be aligned with data collection undertaken by the EMA within the framework of the new Pharmaceutical Legislation. Phasing of data collection is necessary to avoid duplication of data collection and overburdening MAHs with parallel data requests. The phased approach is described below.
For RAMP UP members who submitted medical counter measures outside the scope of the Union list and EMA’s vulnerability assessment exercise (i.e. non-critical medicines, medical devices or PPE), DG HERA will request data in alignment with the SPP elements as applicable (see table in the Annex).
A. Interim data collection phase for medicinal products MCMs
From the launch of RAMP UP until the new Pharmaceutical Legislation enters into force, there will be an interim data collection phase on a voluntary basis.
DG HERA will approach RAMP UP members with the SPP template that is part of the new Pharmaceutical Legislation. Data exchange will be encouraged on a voluntary basis until the legislation enters into force. Communication with MAHs will follow a stepwise approach about data included in the SPP in which DG HERA will provide guidance on the data requested.
In addition to data already included in the SPP template, DG HERA might request additional information for preparedness purposes, including data clusters essential for the RAMP UP initiative (see Annex for data derived from the Pharmaceutical Legislation and the additional information). For each relevant MCM, this will complement DG HERA’s insight into the priority threat area (e.g. pandemic/epidemic pathogens, CBRN threats, AMR, and dual-use MCMs), the expertise and specialization (e.g. vaccines, therapeutics, biomanufacturing capacity, supply chain, logistics, enabling technologies) as well as the location and ramp up production capacity.
B. Data collection under the new Pharma Legislation for medicinal products MCMs
The new Pharmaceutical Legislation, currently projected to be published by the end of Q4 2026, will provide the EMA with the legal basis to collect comprehensive data on marketed products, including their manufacturing and supply chains for the vulnerability assessment (VA) of critical medicines on the Union List (see Annex for data derived from the Pharmaceutical Legislation). Six months after publication of the legislation (Q2 2027), MAHs will be obliged to have this data readily available. If necessary, DG HERA should be able to access the data either through the EMA or through a direct enquiry to the MAHs by means of the Shortage Prevention Plan (SPP) in the context of crisis preparedness as per Article 126 paragraph 2a of the new Pharmaceutical Regulation.
C. Data collection in support of procurement negotiations
In a second phase of outreach, DG HERA will approach RAMP UP members to provide further insight into manufacturing, stockpiling and supply forecasts with the aim to expand DG HERA’s understanding of access to MCMs during health crisis (see phase 2 data in Annex). This data will be specific to RAMP UP and is not covered by the data collection template under the pharmaceutical legislation; itsupports the development of possible reference contractual terms and conditions that may be used to rapidly activate procurement procedures in times of crisis.
Format of data collection
In each of the phases, DG HERA will support members by facilitating data submission and allowing a flexible submission process. The above-mentioned data can either be submitted:
i. in the form of documents available to the members (in various format, pdf, doc(x), JSON, xls); DG HERA will perform data entry of the unstructured data which will be subject to members’ validation or
ii. via a data entry tool that will be available in the HERA Stakeholder Hub.
DG HERA will assist RAMP UP members not only in the data submission process but also releasing guidance documentation for the voluntary submission of the information outlining further which data is necessary to operate RAMP UP.

Working session on RAMP UP – a Rapid Agile Manufacturing Partnership for Union

Introduction
The Preparedness Union Strategy highlights the necessity of quick response to crises, including
public health emergencies. The COVID-19 pandemic exposed deficiencies in timely production
of medical countermeasure (MCM) largely due to the time required to identify and engage suitable
partners, notably for manufacturing and supply purposes. This situation emphasised the need for
an agile network of pre-assessed partners during preparedness phases to facilitate coordinated
emergency responses.
As part of the Medical Countermeasures Strategy, The European Commission proposes the
creation of RAMP UP– Rapid Agile Manufacturing Partnerships for Union Protection – as a
partnership aimed at improving MCM production scalability in crises. Through voluntary
membership and structured confidential collaboration, RAMP UP seeks to establish a committed
network of economic operators with operations in the EU/EEA, enabling DG HERA to quickly
access manufacturing information, map production capacities, anticipate bottlenecks and engage
with crisis-ready partners for faster procurement and mobilisation.
Partnership structure and activities
RAMP UP, set up in preparedness time, intends to function as a voluntary preparedness
information platform including industry partners (covering end-to-end EU/EEA supply-chain) and,
exceptionally, academia or research institutes directly involved in the manufacturing and scaling
up activities. By joining, RAMP UP members would commit to closely collaborate with DG
HERA and to commit resources to tackle serious cross-border health threats for the protection of
the people of the European Union.
During preparedness, participating companies would be asked to share selected information with
DG HERA through secure channels, enabling the creation of a dynamic registry and the
development of crisis-ready contractual and operational tools. In the event of a health crisis, this
framework will allow DG HERA to swiftly identify suitable partners, activate production
partnerships, and launch targeted procurement procedures, with the overall objective of

accelerating manufacturing scale-up and ensuring timely availability of critical medical
countermeasures for the EU.
Beneficiaries and governance
Participation in RAMP UP would be voluntary, free, and continuously open, requiring applicants
to align with HERA’s strategic priorities and agree on harmonised terms, including secure
information sharing and confidentiality agreements compliant with EU legislation. Preference
would be given to manufacturers with EU/EEA operations to ensure security of supply in crisis
times.
Operational aspects, such as membership calls and eligibility criteria, will be defined during the
initiative's launch, currently tentatively set for mid-2026.
Membership is proposed to be open to all supply chain actors with proven relevance in ensuring
access and availability to crisis-relevant MCMs, including but not limited to:
• Manufacturers and marketing authorisation holders of medicines, including vaccine
manufacturers
• Manufacturers of personal protective equipment and medical devices including In Vitro
Diagnostics
• Contract development and manufacturing organisations of MCMs (CDMOs and CMOs)
• Suppliers of raw/intermediate materials, consumables, drug substances and active
pharmaceutical ingredients, and fill-finish services
• Innovators of advanced manufacturing technologies
• Exceptionally, academia and research organisations directly involved in the scaling up
activities of other RAMP UP members.

WAS IST RAMP UP? RAMP UP (Rapid Agile Manufacturing Partnerships for Union Protection) ist eine von der EU (HERA) geplante Partnerschaft, die darauf abzielt, in Krisensituationen die schnelle Skalierung der Produktion kritischer medizinischer Güter zu ermöglichen. Dazu wird bereits in Nicht‑Krisenzeiten ein freiwilliges Netzwerk von Unternehmen entlang der gesamten Lieferkette aufgebaut, das Produktionskapazitäten erfasst, Engpässe frühzeitig identifiziert und im Krisenfall schnell aktiviert werden kann. Die COVID-19-Pandemie hat gezeigt, dass Verzögerungen bei der Identifizierung und Einbindung von Produktionspartnern erhebliche Auswirkungen auf die Fähigkeit der EU hatten, die Produktion medizinischer Gegenmaßnahmen (MCMs) zu skalieren. RAMP UP ist darauf ausgelegt, diese Lücke durch ein freiwilliges, vorab bewertetes Netzwerk wirtschaftlicher Betreiber in der EU/EWR zu schließen und so eine schnell reagierende industrielle Kraft zu schaffen, die die Produktion von MCMs als Reaktion auf eine Gesundheitskrise rasch ausweiten kann. Die Initiative zielt unter anderem darauf ab: ein Register von Herstellern und Akteuren der Lieferkette einzurichten, die in einer Krise reagieren können; der DG HERA die Erfassung der Produktionskapazitäten für MCMs, die Vorhersage von Engpässen und eine effizientere Einbindung von Partnern zu ermöglichen; einen sicheren Datenaustausch und eine vertrauliche Zusammenarbeit sowohl in der Vorbereitungs- als auch in der Reaktionsphase zu unterstützen; eine flexible Vorausplanung in der Vorbereitungsphase zu ermöglichen Die Mitgliedschaft steht allen Akteuren der Lieferkette offen, darunter Herstellern von Arzneimitteln, Medizinprodukte, Lohnherstellern und Rohstofflieferanten sowie – sofern sie direkt an der Produktionssteigerung beteiligt sind – akademischen Einrichtungen mit EU-/EWR-Relevanz, um das Ziel der Stärkung der Produktionsbasis und der strategischen Autonomie der EU/des EWR zu unterstützen. Ein Kernelement der Funktionsweise von RAMP UP ist der Datenaustausch. Zu diesem Zweck wurde die „Data Strategy Note“ entwickelt. Gefordert wird die Streichung mehrerer vorgesehener Ausgabenbremsen bei Krankenhäusern, Arztpraxen, Apotheken und Pharmabranche. Der Bundesrat stimmt in seiner Sitzung am 12. Juni darüber ab, welche der Ausschussempfehlungen er sich zu eigen macht. Der federführende Gesundheitsausschuss mahnt unter anderem: «Die Sparmaßnahmen dürfen nicht zu einem Kliniksterben führen und in einer kalten und ungesteuerten Strukturbereinigung münden.» Zur Konsolidierung der Finanzen der gesetzlichen Krankenkassen müsse auch der Krankenhaussektor seinen Beitrag leisten. Durch die geplanten Maßnahmen seien aber eine «hohe Insolvenzgefahr» und eine überproportional starke Belastung zu erwarten. Entlastung der Kassen um 16 Milliarden Euro Das vom Bundeskabinett auf den Weg gebrachte Paket soll die gesetzlichen Kassen 2027 um 16,3 Milliarden Euro entlasten, um ein erwartetes Defizit auszugleichen und neue Anhebungen der Zusatzbeiträge zu vermeiden. Warken plant Ausgabenbremsen bei allen Leistungserbringern - aber etwa auch höhere Zuzahlungen für Medikamente und Einschränkungen der kostenlosen Mitversicherung von Ehepartnern. Der Entwurf soll am 12. Juni auch in den Bundestag kommen. Der Bundesrat kann zunächst Stellung dazu nehmen. Das Gesetz ist nicht zustimmungsbedürftig, die Länder könnten es aber bremsen. Bei den Kliniken sollen Ausgaben von 4,6 Milliarden Euro vermieden werden. Die zuständigen Ausschüsse der Länderkammer empfehlen als Forderung, mehrere Instrumente dafür zu streichen - etwa, dass Tariflohnsteigerungen, die über eine bestimmte Schwelle hinausgehen, nicht mehr voll von den Kassen getragen werden, sondern nur noch zur Hälfte. Auch ein Limit für Anstiege beim «Pflegebudget» solle gestrichen werden. Daraus werden - ausgegliedert aus der generellen Klinikvergütung - die Kosten fürs Pflegepersonal finanziert. Einwände gegen Kürzung bei Zahnersatz Vorbehalte aus den Bundesrats-Ausschüssen werden auch bei weiteren Teilen des Sparpakets deutlich. Wenn Festzuschüsse für Zahnersatz von 60 auf 50 Prozent gesenkt würden, lasse dies allgemeine Kostensteigerungen etwa für Labore außer Betracht. Auf Versicherte kämen Belastungen zu. Dass bestimmte Operationen erst nach dem Einholen einer zweiten ärztlichen Meinung von den Krankenkassen vergütet werden sollen, führe zur Gefahr von Wartezeiten. Ablehnung kommt aus den Ausschüssen auch zur geplanten Abschaffung finanzieller Anreize für Praxen für schnellere Terminvermittlungen, was die Bundesregierung mit ausgebliebenen Verbesserungen begründet. Ebenfalls abgelehnt werden Regelungen zu größeren Preisrabatten, die Apotheken und Arzneimittelhersteller den Kassen gewähren müssen. Eine Stärkung des Produktions- und Forschungsstandorts solle stärker berücksichtigt werden. Auch Regelungen für Beamte anpassen Angemahnt wird von den Bundesrats-Ausschüssen auch eine größere Mitfinanzierung der Krankenkosten von Bürgergeldbeziehern durch Steuergeld aus dem Bundeshaushalt. Die anstehenden Reformen müssten - aus Gründen der Akzeptanz - auch ihren Niederschlag in der Versorgung von Beamtinnen und Beamten finden. Etwaige Änderungen bei der Einkommensgrenze, bis zu der Beiträge fällig werden, seien «unter der Maßgabe zu prüfen, dass die Belastungen der breiten Mitte der Beitragszahlerinnen und Beitragszahler nicht weiter erhöht werden». Im Entwurf geplant ist eine zusätzliche Anhebung 2027. Der Vorstand der Deutschen Stiftung Patientenschutz, Eugen Brysch, sagte mit Blick auf die geballten Einwände aus den Ländern: «Nina Warken muss endlich erkennen, dass besonders Sozialgesetze nicht in wissenschaftlichen Zirkeln gemacht werden.» Es brauche vielmehr den politischen Diskurs. «Dabei gilt es, mindestens die Regierungsfraktionen einzubinden», mahnte Brysch.

Der Vorstand des Pharmapools hat am 18. Mai 2026 in seiner turnusgemäßen Sitzung – nach Anhörung des Beirats – beschlossen, den Vorausrabatt für den Deckungsbereich 114 Mio. € nach 6 Mio. € ab Hauptfälligkeit 01.01.2027 von aktuell 31% um drei Prozentpunkte auf 34% zu erhöhen. Die Mindestbeiträge für die Pharmapooldeckung bleiben ab Hauptfälligkeit 01.01.2027 unverändert bei 225,00 € bzw. bei ausschließlichem Direktvertrieb an Endverbraucher bei 112,50 €. Den Beschlüssen des Vorstands des Pharmapools sind intensive Gespräche über die Wirkung der Erhöhung des Vorausrabattes sowie der für die Prämienhöhe relevanten Faktoren vorausgegangen. Der Beirat des Pharmapools hat insbesondere darauf verwiesen, dass (weiterhin) keine maßgeblichen Änderungen im Hinblick auf Großschäden, Rechtsrahmen und Risikolandschaft zu verzeichnen sind und deshalb die Prämien spürbar sinken müssten. Nach Auffassung des Vorstands des Pharmapools komme jedoch die Anhebung des Vorausrabatts von aktuell 31% um drei Prozentpunkte auf 34% wirtschaftlich einer Absenkung des Pharmapool-Tarifs gleich, von der – mit Ausnahme der Mindestbeitragsrisiken – alle Versicherungsnehmer profitieren (sollten). Zwar konnte der Beirat diese Ansicht des Vorstandes nicht teilen, da die Entscheidung im Wesentlichen auf eine Stundung des Tarifs bis zu einem großen Schadenfall bzw. Schadenkomplex hinauslaufen würde. Dennoch blieb der Vorstand des Pharmapools bei seiner Linie. Gleichwohl ist es zu begrüßen, dass der Pharmapool sich offen zeigt, aktuell in einen Dialog über die wesentlichen Parameter zur Festlegung der Höhe des Pharmapool-Tarifs einzutreten. Hierzu sollen in der zweiten Jahreshälfte (2026) Vorschläge von Seiten des Beirates vorgelegt werden, die der Pharmapool bis zur nächsten gemeinsamen Sitzung (von Vorstand und Beirat) im Mai 2027 einer Bewertung unterziehen will.

Im März 2023 hatte das HMPC einen Aufruf zur Einreichung wissenschaftlicher Daten (Call for data) zu Lecithinum ex soya veröffentlicht. Auf Grundlage der eingegangenen Daten hat das HMPC einen Monographie-Entwurf erstellt und im Mai 2026 zur Konsultation angenommen. Neben dem Monographie-Entwurf wurden auch die dazugehörigen Entwürfe der Begleitdokumente (Assessment Report und Literaturliste) veröffentlicht. Alle Dokumente sind auf der Lecithinum ex soya-Seite unter „Documents“ abrufbar. Interessierte Mitgliedsunternehmen von Pharma Deutschland, die sich an einer Kommentierung des oben genannten Monographie-Entwurfs beteiligen möchten, werden gebeten ihre Anmerkungen bis zum 31.
