AESGP comments on the EC Concept Paper on the delegated act
on the principles and guidelines of good manufacturing practice
for active substances in medicinal products for human use
AESGP represents manufacturers of non-prescription medicines of either chemical or herbal origin
at European level. It counts 29 national associations and 25 associate members. Through its national
and associate members, it represents many small and medium-sized companies operating in the
self-care sector.
AESGP appreciates the opportunity to take part in this very important consultation.
Overall we would prefer that the Directive is revised in a way to cover finished medicinal products
and APIs in two distinct parts, one focusing on finished products, the second one focusing on APIs.
We also think the specific case of atypical/non-traditional actives should be reflected in this revised
Directive via a specific article defining this category of substances and referring to a specific annex
(as it exists one for e.g. herbal medicines – cf. annex 7).
We also would like to raise attention to specific challenges inherent to the manufacturing of herbal
and homeopathic medicinal products as manufacturers are using a very large number of different
herbal and homeopathic starting material. Herbal and homeopathic substances may be of different
types. They may for instance be derived from plants (herbal and homeopathic products) or mineral,
animal or chemical raw materials (homeopathic products) and they come from various geographical
origins. Often, they are needed only in very small amounts and many of them are collected in the
wild and immediately processed (starting from fresh plant material). This makes the evaluation of
the impact particularly difficult with respect to guidelines applying to active substances.
Manufacturers apply GMPs for the production of active substances (for instance in the production
of mother tinctures) but consequences for rare substances or atypical actives are difficult to
evaluate. In particular we fear extensive administrative burdens and possibly high costs (eg. costs
linked to inspections) in view of the numerous herbal and homeopathic products and the numerous
different types of substances used for our products.
Consultation item No 1 – Proposal to extend the scope of Directive 2003/94/EC to active
substances
Do you agree with this appraisal and approach? Please comments
We agree in principle with the objective to bring coherence into the regulatory setting for medicinal
products and active substances. However, we have concerns with the approach to extend the scope
of Directive 2003/94/EC to active substances without differentiation between the requirements
applying to finished medicines vs. active pharmaceutical substances. The various differences in
interpretation of 'drug product GMPs' vs. 'drug substance GMPs' may give rise to a lot of
exemptions which, in total, would then complicate the GMP text and dilute the purpose of having
clear guidance.

With the aim of having a clear and simple structure of the Directive, we suggest reorganizing
Directive 2003/94/EC into two chapters: one for medicinal products and investigational medicinal
products – this part which already exists could be grouped under a heading Chapter 1 Medicinal
products – and a second one for active substances – chapter to be created under a heading Chapter
2 Active substances. We would agree to the extension of the scope of the Directive 2003/94/EC only
under that condition of having two clear and distinct parts as outlined above. Alternatively a distinct
Directive on GMP for APIs would also be agreeable.
The part concerning APIs should be fully in line with GMP Part II i.e. ICH Q7A.
Consultation item No 2 – Adaptation of regulatory requirements of Directive 2003/94/EC to active
substances
Are there other aspects which should be considered ? Please comment
We welcome the explicit listing of provisions of Directive 2003/94/EC that would not apply to drug
substances. However, as suggested under consultation item 1, we would prefer having two distinct
sections on the Directive so as to ensure clarity.
In addition to the aspects mentioned under 2.1. several other aspects need to be clarified,
including, but not limited to the following examples:
1) Article 9(1) 2003/94/EC must not establish document retention times different from those stated
in ICH Q7A, 6.13.
2) Article 11 2003/94/EC must not establish sample retain periods different from those in ICH Q7A,
11.71.
In addition, we propose to consider also the aspect of non-traditional (atypical) active substances.
Those are substances which are used in much greater quantities in other industries and for which
manufacturers have little incentives to comply with full GMP part II. The following EMA
acknowledged the existence of atypical actives and proposed a pragmatic solution concerning GMP
compliance. It states that: “Full compliance with GMP for finished products and active substances is
a legal obligation for Manufacturing Authorisation holders. It is recognised that for a small number
of medicinal products the primary use of the active substance is not in a medicinal product and the
producer may therefore not be aiming to meet the specific requirements of pharmaceutical
customers that represent an insignificant volume of business. Alternative sources should normally be
sought but in exceptional circumstances the manufacturing authorisation holder should assess and
document to which extent GMP is complied with and provide a risk-based justification for the
acceptance of any derogation. The declaration provided by the Qualified Person should set out in
detail the basis for declaring that the standards applied provide the same level of assurance as GMP.
The European Medicines Agency will collect experience with this approach which can be used as a
basis for discussion on related amendments to guidelines in the future.”
Some provisions are not applicable as such for these actives and as a consequence, appropriate
measures should be foreseen for this type of active substances such as those sourced from nature.
For instance, the manufacturer of the active substance could ascertain the appropriate good
manufacturing practice on the basis of a formalised risk assessment taking into account compliance
with other appropriate quality systems, the source, the intended use and previous instances of
quality defects.

In particular the provisions stipulated particularly in Article 3 (Inspections), article 4 (Conformity
with GMP) and article 6 (QA system) of Dir 2003/94/EC have to be fit to the specific situation of
these active substances. As a principle, such inspections, manufacturing practices and QA systems
must provide confidence that the atypical active in question is fit for purpose and will not negatively
affect the safety and efficacy of the medicinal product. To achieve this aim the necessary measures
for qualification of the atypical active manufacturer have to be evaluated on a scientific basis and a
risk assessment on product specific basis.
We would propose that the specific situation of atypical actives be reflected in the revised Directive
2003/94/EC and that further guidance is provided later on in a specific annex dedicated to atypical
actives including recommendations on the risk-based approach. For example, the following
elements could be mentioned for consideration and use, as appropriate, by applicants which cannot
declare their API as fully GMP-compliant:
1. The dosage form manufacturer or MAH should perform a quality assessment of the atypical
actives manufacturer against the requirements of Part II of the GMP Guide in order to identify
gaps.
These gaps should be subject to a risk assessment of deviations from GMP and the rationale
documented for continued acceptance of material from that source,
1. Clear specification for the material being purchased, detailing both product critical chemical
and physical attributes, as appropriate. This should be agreed between the supplier and the
purchaser.
1. A quality agreement which includes a requirement to notify changes between the atypical
active manufacturer and the dosage form manufacturer (and any other intermediaries) or MAH
should be striven for.

We refer to our first comment in which we expressed our preference for having two clear and
distinct sections in the Directive (or a separate Directive covering GMP for APIs).
Consultation item No 4 – Other provisions on active substances that could be added to Directive
2003/94/EC e.g. provisions specific to active substances, in particular an obligation could be
placed on the manufacturer of the active substance to make ensure that the starting material is
sourced from the premises claimed by the manufacturer of the starting material.
Do you agree with this specific point? Do you consider that other provisions specific to active
substances should be added?
To our point of view, the addition of an obligation on the manufacturer of the active substances to
make sure that the starting material is sourced from premises claimed by the manufacturer of the
starting material largely exceeds the framework of the GMP for active substances. Indeed, current
GMP part II applies to steps following the first introduction of the starting material in the process of

the manufacture of the active substance only.
We refer in particular to the increasing uptake of GMP standards in manufacturing. For herbal
substances/preparations, it is important to underline that the first steps are covered by GACP and
not GMP. This essential nuance should not be jeopardized by the Directive.

INTRODUCTION
1. On 1 July 2011, Directive 2011/62/EU of the European Parliament and of the
Council of 8 June 2011 amending Directive 2001/83/EC on the Community code
relating to medicinal products for human use, as regards the prevention of the entry
into the legal supply chain of falsified medicinal products was published.1 This
Directive amends Directive 2001/83/EC on the Community code relating to
medicinal products for human use.2
2. Directive 2011/62/EU places an obligation on Member States to take appropriate
measures to ensure that manufacturers of active substances on their territory comply
with good manufacturing practice ('GMP') for active substances.3
3. It also places an obligation on the Commission to adopt, by means of delegated
acts,4 the principles and guidelines of good manufacturing practice for active
substances.5
4. This concept paper is being released for public consultation with a view to preparing
the delegated act.
5. The adoption of the delegated act is planned for 2013.
Stakeholders are invited to comment on this consultation paper, and especially on the boxed text, by 20
April 2012 at the latest. Responses should be sent preferably by e-mail to sanco-pharmaceuticals-

6. The Commission has adopted, on 8 October 2003, Directive 2003/94/EC laying
down the principles and guidelines of good manufacturing practice in respect of
medicinal products for human use and investigational medicinal products for human
use.6
7. Directive 2003/94/EC lays down the principles and guidelines in a comparatively
broad manner. The interpretation of these principles and guidelines provided in the
detailed guidelines published by the Commission7 in EudraLex - Volume 4, Part I.8
8. Similarly, detailed guidelines on good manufacturing practices for active substances
(ICH Q7) have been published by the Commission in EudraLex – Volume 4, Part
II.9
9. Against this background it is therefore currently envisaged to extend the scope of
Directive 2003/94/EC to active substances. Consequently, subject to certain
modifications (see below), the provisions of Directive 2003/94/EC would also apply
to the manufacturing of active substances.
10. This approach would bring coherence:
• in terms of the regulatory setting (Commission Directive plus detailed
Commission guidelines) for both medicinal products and active substances; and
• in terms of substance: the principles and guidelines for GMP would be the same
during the manufacturing of active substances as well as medicinal products.
Moreover, this approach would allow relatively swift adoption of GMP for active
substances, thus giving legal clarity to Member States and stakeholders.

2. Adaptation of regulatory requirements of Directive 2003/94/EC to active
substances
11. In line with the approach to extend the scope of Directive 2003/94/EC to active
substances, all provisions in that Directive which currently address the
manufacturing or manufacturer of medicinal products would also apply to the
manufacturing and manufacturer of active substances. However, it is
acknowledged that some of the current provisions in Directive 2003/94/EC either

cannot apply to active substances (see point 2.1) or will have to be amended (see
point 2.2). Moreover, some further provisions specific to active substances could be
added (see point 2.3).
2.1. Provisions in Directive 2003/94/EC that would not apply to active
substances
12. As a general rule, the following provisions in Directive 2003/94/EC would not
apply to active substances:
• Provisions reflecting specific rules for medicinal products contained in Directive
2001/83/EC. This includes the rules in Directive 2003/94/EC that build on the
following:
– Marketing authorisations for medicinal products (the placing on the market
of active substances per se is not subject to a marketing authorisation);
– Qualified persons (the concept of 'qualified person' does not apply to active
substances); and
– Manufacturing authorisations for the manufacturing of medicinal products
(the manufacturing of active substances is not subject to a manufacturing
authorisation10).
• Provisions addressing investigational medicinal products (these products are
outside the scope of Directive 2001/83/EC11 and thus outside the scope of its
rules on active substances).
13. Consequently, the following provisions in Directive 2003/94/EC would not apply to
active substances:
• Article 4(1) ('Conformity with good manufacturing practice') – insofar as it
relates to the manufacturing authorisation: The manufacturing of active
substances is not subject to an authorisation.
• Article 4(2) ('Conformity with good manufacturing practice'): Regarding
importation, Directive 2001/83/EC contains specific rules in Article 46b(2) to
(4);
• Article 7(2) ('Personnel') – insofar as it relates to the qualified person: The
concept of 'qualified person' does not apply to active substances;
• Article 9(1) second sub-paragraph ('Documentation') – insofar as it relates to
Article 51(3) of Directive 2001/83/EC: The obligation in Article 51(3) of
Directive 2001/83/EC does not apply to active substances;
• Article 11(2) first sub-paragraph ('Quality control') – Article 20(b) of Directive
2001/83/EC does not apply to active substances;

• Article 12(2) ('Work contracted out') – insofar as it relates to the qualified
person: The concept of 'qualified person' does not apply to active substances;
• Article 13(1) second sub-paragraph ('Recalls'): Article 123 of Directive
2001/83/EC does not apply to active substances;
• All provisions relating to investigational medicinal products, including the
provision on unblinding and labelling of investigational medicinal products.

2.2. Provisions in Directive 2003/94/EC that would need to be amended
14. In addition, the following provisions in Directive 2003/94/EC would need to be
amended:
• Article 1 ('Scope'): The scope would be extended to active substances;
• Article 2 ('Definitions'):
– The definition of 'active substance' contained in Article 1(3a) of Directive
2001/83/EC would be added;
– The definition of 'manufacturer' contained in Article 46a(1) of Directive
2001/83/EC would be added.

2.3. Other provisions on active substances that could be added to
Directive 2003/94/EC
15. Another point which could be considered is whether to add to Directive 2003/94/EC
provisions specific for active substances.
16. In particular, an obligation could be placed on the manufacturer of the active
substance to make ensure that the starting material12 is sourced from the premises
claimed by the manufacturer of the starting material.

3. Other issues
3.1. Date of transposition of the delegated act
17. The delegated act would take the form of a Directive, which requires transposition
into the national law of the Member States.
18. In line with the transposition timeline in Directive 2003/94/EC, the time limit for
transposition would be 6 months after publication of the delegated act at the latest.13

3.2. Date of application of the delegated act
19. The date of application of the delegated act and the national laws transposing it
would be set later than the date of transposition at nine months after publication of
the delegated act.

Anlage VI - Off-Label-Use
Gabapentin zur Behandlung der Spastik im
Rahmen der Multiplen Sklerose
Vom 23. Januar 2014
Der Gemeinsame Bundesausschuss hat in seiner Sitzung am 23. Januar 2014 beschlossen,
die Richtlinie über die Verordnung von Arzneimitteln in der vertragsärztlichen Versorgung
(Arzneimittel-Richtlinie) in der Fassung vom 18. Dezember 2008 / 22. Januar 2009 (BAnz.
Nr. 49a vom 31. März 2009), zuletzt geändert am 20.02.2014 (BAnz AT 12.03.2014 B2), wie
folgt zu ändern:
I. Der Anlage VI der Arzneimittel-Richtlinie wird in Teil A eine Ziffer XX. wie folgt angefügt:
„XX. Gabapentin zur Behandlung der Spastik im Rahmen der Multiplen Sklerose
1. Hinweise zur Anwendung von Gabapentin zur Behandlung der Spastik bei Multipler
Sklerose gemäß § 30 Abs. 2 AM-RL
a) Nicht zugelassenes Anwendungsgebiet (Off-Label-Indikation):
Spastik bei Multipler Sklerose, wenn mit den dafür zugelassenen Substanzen bei
angemessener Dosierung und Anwendungsdauer keine ausreichende Linderung
erzielt werden konnte oder Unverträglichkeit vorliegt.
b) Behandlungsziel:
Linderung des gesteigerten, spastischen Muskeltonus und Reduktion der Häufigkeit
schmerzhafter krampfartiger Muskeltonussteigerungen (Spasmen, Myoklonien).
c) Folgende Wirkstoffe sind zur Behandlung der Spastik im Rahmen der Multiplen
Sklerose zugelassen:
Baclofen (oral), Baclofen (intrathekal),
Tizanidinhydrochlorid,
Nabiximols - Delta-9-Tetrahydrocannabinol (THC) + Cannabidiol (CBD)
d) Spezielle Patientengruppe:
Patienten mit Multipler Sklerose und spastischer Bewegungsstörung (Tetra- oder
Paraspastik) und/oder schmerzhafte Spasmen. Einschränkungen hinsichtlich
anderer Begleiterkrankungen bestehen nach dem aktuellen wissenschaftlichen
Erkenntnisstand (10/2012) nicht bzw. entsprechen der aktuellen Fachinformation
für die zugelassenen Anwendungsgebiete.

e) Nennung der Patienten, die nicht behandelt werden sollen:
Gegenanzeigen entsprechen denen der aktuellen Fachinformation für die
zugelassenen Anwendungsgebiete.
f) Dosierung:
Gabapentin soll einschleichend mit einer Einzeldosis von 100 mg 3 bis 4 x täglich
ein-dosiert werden. Die Aufdosierung erfolgt nach klinischer Wirkung. Die Wirkdosis
liegt zwischen 1200 mg/die (Mueller et al. 1997) und 2700 mg/die (Cutter et al.
2000).
g) Behandlungsdauer:
Ein responder-Status kann 1 bis 2 Wochen nach Erreichen der Zieldosis von 1200
mg/die beurteilt werden. Die Behandlungsdauer richtet sich nach Erfordernis und
klinischer Wirkung auf das Zielsymptom. Die Behandlung ist zu beenden, wenn
keine Wirksamkeit erkennbar ist. Gabapentin sollte dabei ausschleichend reduziert
werden, da bei plötzlichem Absetzen die Gefahr von Krampfanfällen besteht.
h) Wann sollte die Behandlung abgebrochen werden?
Die Behandlung muss abgebrochen werden bei Unverträglichkeit (siehe aktuelle
Fachinformation für die zugelassenen Anwendungsgebiete).
i) Nebenwirkungen/Wechselwirkungen, wenn diese über die der aktuellen
Fachinformation für die zugelassenen Indikationen hinausgehen oder dort nicht
erwähnt sind:
Nach der Berufsordnung der Ärzte sind Verdachtsfälle von Nebenwirkungen, deren
Art, Ausmaß oder Ergebnis von den in der Fachinformation genannten abweichen,
der Arzneimittelkommission der deutschen Ärzteschaft (AkdÄ) bzw. der
zuständigen Bundesoberbehörde zu melden. Dies gilt auch für Arzneimittel, die im
Off-Label-Use eingesetzt werden. Auch für Patienten besteht die Möglichkeit,
Nebenwirkungen direkt an die Bundesoberbehörden zu melden.
j) Zustimmung des pharmazeutischen Unternehmers:
Die folgenden pharmazeutischen Unternehmer haben für ihre
Gabapentin-haltigen Arzneimittel eine Anerkennung des bestimmungsgemäßen
Gebrauchs abgegeben (Haftung des pharmazeutischen Unternehmers), sodass
ihre Arzneimittel für die vorgenannte Off-Label-Indikation verordnungsfähig sind:

1. Rechtsgrundlage
Nach § 35c Abs. 1 SGB V werden dem Gemeinsamen Bundesausschuss (G-BA) die
Empfehlungen der vom BMG berufenen Expertengruppen zum Stand der wissenschaftlichen
Erkenntnisse über die Anwendung von zugelassenen Arzneimitteln für Indikationen oder
Indikationsbereiche, für die sie nach dem Gesetz über den Verkehr mit Arzneimitteln
(Arzneimittelgesetz/AMG) nicht zugelassen sind, zur Beschlussfassung zugeleitet.
Der Gemeinsame Bundesausschuss soll in der Richtlinie nach § 92 Abs. 1 Satz 2 Nr. 6
SGB V (Arzneimittel-Richtlinie) festlegen, welche zugelassenen Arzneimittel in nicht
zugelassenen Anwendungsgebieten verordnungsfähig sind.
Die Regelungen der Verordnungsfähigkeit von zugelassenen Arzneimitteln in nicht
zugelassenen Anwendungsgebieten (sog. Off-Label-Use) sind in Abschnitt K der
Arzneimittel-Richtlinie (AM-RL) aufgeführt. Zum Zwecke der Konkretisierung dieses
Abschnittes K ist eine Anlage VI angefügt.
In § 30 Abs. 1 des Abschnittes K der AM-RL sind die Voraussetzungen für eine
Verordnungsfähigkeit von zugelassenen Arzneimitteln im Off-Label-Use aufgeführt.
Voraussetzungen sind
1. dass die Expertengruppen mit Zustimmung des pharmazeutischen Unternehmers eine
positive Bewertung zum Stand der wissenschaftlichen Erkenntnis über die Anwendung
dieser Arzneimittel in den nicht zugelassenen Indikationen oder Indikationsbereichen als
Empfehlung abgegeben haben
und
2. dass der G-BA die Empfehlung in Anlage VI Teil A übernommen hat.
In Teil A der Anlage VI werden somit verordnungsfähige Arzneimittel in
zulassungsüberschreitenden Anwendungen (Off-Label-Use) aufgelistet (gemäß § 30 Abs. 1
AM-RL), sowie die Angaben zur ggf. notwendigen Verlaufsdokumentation (gemäß § 30
Abs. 4 AM-RL). Notwendige Voraussetzungen dafür sind die Zustimmung des
pharmazeutischen Unternehmers sowie eine positive Empfehlung durch die Expertengruppe.
Bei der Umsetzung der Empfehlungen der Expertengruppe prüft der Gemeinsame
Bundesausschuss, ob die Anwendung des Wirkstoffes in der Off-Label-Indikation
medizinisch notwendig und wirtschaftlich ist.
§ 30 Abs. 5 des Abschnitts K der AM-RL regelt, wann eine Verordnungsfähigkeit von
Arzneimitteln im Off-Label-Use nicht gegeben ist. Für Arzneimittel, deren Anwendung in nicht
zugelassenen Indikationen oder Indikationsbereichen nach Bewertung der Expertengruppen
nicht dem Stand der wissenschaftlichen Erkenntnis entspricht oder die medizinisch nicht
notwendig oder unwirtschaftlich sind, ist eine Verordnungsfähigkeit dementsprechend nicht
gegeben. Diese werden in Anlage VI Teil B der AM-RL aufgeführt.

2. Eckpunkte der Entscheidung
Mit Briefdatum vom 6. Februar 2013 ist dem G-BA durch die Geschäftsstelle Kommissionen
des Bundesinstituts für Arzneimittel und Medizinprodukte (BfArM) eine aktualisierte
Bewertung (Stand: 1. Revision 11.12.2012) der Expertengruppe Off-Label im Bereich
Neurologie/Psychiatrie nach § 35c Abs. 1 SGB V zum Stand der wissenschaftlichen
Erkenntnis zur Anwendung von Gabapentin zur Behandlung der Spastik im Rahmen der
Multiplen Sklerose zur Umsetzung in der Arzneimittel-Richtlinie zugeleitet worden.
Die entsprechende Bewertung ist auch auf den Internetseiten des BfArM, www.bfarm.de,
veröffentlicht.
Die vom Unterausschuss Arzneimittel eingesetzte Arbeitsgruppe „Off-Label-Use“ hat die
Empfehlung der Expertengruppe zur Anwendung von Gabapentin zur Behandlung der
Spastik im Rahmen der Multiplen Sklerose überprüft.
Die Expertengruppe kommt zu folgendem Fazit:
„Der Off-Label-Einsatz von oralem Gabapentin zur Therapie der spastischen
Bewegungsstörung (Tetra-, Paraspastik) und nächtlicher schmerzhafter Spasmen bei
generalisierter Spastik bei MS des Erwachsenen ist gerechtfertigt, wenn für die Spastik bei
MS zugelassene Antispastika wegen Unverträglichkeit, unerwünschter Wirkungen oder
fehlender Wirksamkeit nicht angewendet werden können.
Die niedrigste wirksame Dosis scheint nach dem Stand der wissenschaftlichen Erkenntnis
um 1200 mg /die zu liegen (Mueller et al. 1997); Dosisfindungsstudien zur Therapie der
Spastik bei MS sind nicht veröffentlicht, allerdings wird der wirksame Dosisbereich von
Cutter et al.(2000) mit 2700 mg/die angegeben. Formica et al. (2005) geben 2700 - 3600 mg
als wirksame Tagesdosis an.
Eine Kombination mit anderen Antispastika (Add-on-Therapie) ist fallindividuell möglich bei
sorgfältiger Überwachung der klinischen Wirkung.“
Der Unterausschuss Arzneimittel ist nach Würdigung der Bewertung der Expertengruppe
und der Beratungen der Arbeitsgruppe „Off-Label-Use“ zu dem Ergebnis gekommen, dass
die sachgerechte Bearbeitung des erteilten Auftrages plausibel ist und die Empfehlung durch
folgende Ergänzung der Anlage VI in Teil A
„XX. Gabapentin zur Behandlung der Spastik im Rahmen der Multiplen Sklerose“
umzusetzen.
Aus den im Rahmen des Stellungnahmeverfahrens eingegangenen Stellungnahmen haben
sich keine Änderungen zum Richtlinienentwurf ergeben.
Insbesondere die Studien von Mueller et al. 1997 und Cutter et al 2000 sowie der Cochrane-
Review von Shakespeare et al. 2003 wurden bereits in die Bewertung durch die
Expertengruppe, inwieweit die Datenlage für die Anerkennung eines Off-Label-Use
ausreicht, mit einbezogen.
Auch die Aussagen zum Einsatz von Gabapentin bei MS-bedingter Spastik in dem zusätzlich
angeführten HTA-Bericht „Treatments for spasticity and pain inmultiple sclerosis: a
systematic review“ (Beard et al. 2003) basieren auf den Studien von Mueller et al. 1997 und
Cutter et al 2000. Demnach wird die aus diesen Studien abgeleitete Evidenz für eine
Wirksamkeit von Gabapentin bei MS-bedingter Spastik nicht Frage gestellt, wenngleich
zusätzliche Langzeitdaten für erforderlich gehalten werden. („These two studies provide
some evidence that gabapentin is effective in alleviating clinical measures of spasticity, at
least in the short term. The longer term effect of the drug on spasticity is not established, but
on the basis of these findings, warrants further investigation.” Ausweislich der Bewertung der
Expertengruppe weisen Fallbeobachtungen und Fallserien ergänzend darauf hin, dass mit
Gabapentin „eine alltagsrelevante Besserung einer Spastik bei einer geringen
Nebenwirkungsrate über Wochen bis Monate erreicht werden kann“. Die Expertengruppe

geht deshalb davon aus, dass „ein längerfristiger Nutzen bei dauerhafter Therapie“ durch
diese Untersuchungen nahe liegt.
Bei der Studie von Starck et al. 2009 handelt es sich um eine vergleichende Untersuchung
der Wirksamkeit von Memantine und Gabapentin an 11 MS-Patienten mit einem erworbenen
Pendelnystagmus. Die dabei beobachteten Nebenwirkungen (Muskelschwäche, Zunahme
der Ataxie, Ermüdung, gesteigerte Spastik, Schwindel und Ruhelosigkeit) werden in
ähnlicher Weise auch im Abschnitt Nebenwirkungen der Fachinformation gelistet. Aufgrund
der geringen Zahl untersuchter Patienten, die Gabapentin auch nicht aufgrund einer MS-
bedingten Spastik sondern wegen eines Pendelnystagmus erhielten, lassen sich hieraus
keine Rückschlüsse zu möglichen Nebenwirkungen von Gabapentin speziell bei der
Behandlung der Spastik im Rahmen der Multiplen Sklerose, die über die Fachinformation für
die zugelassenen Indikation hinausgehen, ableiten.
3. Bürokratiekosten
Durch den vorgesehenen Beschluss entstehen keine Informationspflichten für
Leistungserbringerinnen und Leistungserbringer im Sinne von Anlage II zum 1. Kapitel VerfO
und dementsprechend keine Bürokratiekosten.
4. Verfahrensablauf
Zur Vorbereitung einer Beschlussempfehlung zur Einleitung eines Stellungnahmeverfahrens
sowie zur Auswertung der Stellungnahmen hat der Unterausschuss Arzneimittel eine
Arbeitsgruppe beauftragt, die sich aus den von den Spitzenorganisationen der
Leistungserbringer benannten Mitgliedern, der vom GKV-Spitzenverband benannten
Mitglieder sowie Vertreter(innen) der Patientenorganisationen zusammensetzt.
In der Sitzung am 9. Juli 2013 wurde im Unterausschuss Arzneimittel die Bewertung der
Expertengruppe zur Anwendung von Gabapentin zur Behandlung der Spastik im Rahmen
der Multiplen Sklerose als Empfehlung angenommen und deren Umsetzung in die
Arzneimittel-Richtlinie abschließend beraten und konsentiert.
Der Unterausschuss hat in der Sitzung am 9. Juli 2013 nach dem 1. Kapitel § 10 Abs. 1 der
Verfahrensordnung des G-BA die Einleitung des Stellungnahmeverfahrens einstimmig
beschlossen.
Im Rahmen des schriftlichen Stellungnahmeverfahrens sind zwei Stellungnahmen
eingegangen. Eine mündliche Anhörung wurde jedoch nicht durchgeführt, da die
Stellungnahmeberechtigten von ihrem Recht auf Anhörung keinen Gebrauch gemacht
haben.
Der Unterausschuss Arzneimittel hat die Beschlussvorlage in der Sitzung am
10. Dezember 2013 ohne weitere Änderungen konsentiert.

Der Gemeinsame Bundesausschuss hat in seiner Sitzung am 20. Februar 2014
beschlossen, die Richtlinie über die Verordnung von Arzneimitteln in der vertragsärztlichen
Versorgung (Arzneimittel-Richtlinie) in der Fassung vom 18. Dezember 2008 / 22. Januar
2009 (BAnz. Nr. 49a vom 31. März 2009), zuletzt geändert am 20. Februar 2014 (BAnz AT
12.03.2014 B2), wie folgt zu ändern:
I. Die Ziffer XII. der Anlage VI Teil A zur Arzneimittel-Richtlinie wird unter Nr. 1 lit. j)
„Zustimmung des pharmazeutischen Unternehmers“ wie folgt geändert:

We understand that this guideline has not been drafted
to address cross-contamination issues which would have
occurred in practice but rather to recommend a more
scientific approach based on the pharmacological and
toxicological profile of the substances. We believe that
both the approach described in this guideline --which we
will call “PDE approach” -- and the current widely
accepted approach should co-exist and be considered
as equivalent and equally acceptable approaches.
Companies should be able to chose the approach
they want to follow.
We think it is appropriate to keep the current approach
i.e. criterion (e.g. 10 ppm) concerning the risk
evaluation as part of the cleaning validation process. On
that basis it can be decided whether the manufacturing
of the respective medicinal product should be executed
in dedicated or in shared facilities.
Particular APIs and corresponding medicines (penicilins,
certain antibiotics, certain hormones, highly sensitizing
substances etc.) may benefit from following the PDE-
approach but again this decision to choose the current or
the PDE approach should be left to the company.
The PDE- approach should in any case not be required
for all medicinal products and all active substances but
should be an option for companies that chose to follow it
e.g. by the producers of certain hazardous contaminants

such as highly sensitising materials (such as beta
lactams), biological preparations (e.g. from live micro-
organisms), certain hormones, cytotoxics, and other
highly active materials.
Applying the proposed guideline to all APIs and finished
products would be excessive and would engender
unnecessary high cost with minimum value added.
The possibility of a dual approach would not be new as in
another field the ICH Q8 guideline already offered the
possibility for companies to choose between a so-called
“traditional approach” and a more “enhanced approach”.
More flexibility with the use of higher PDE values in
specific cases should be possible. For example,
when compounds with the same mode of action (e.g.
all cytotoxic anticancer drugs, or all ACE inhibitors),
or when only veterinary products are produced on
the facility;
or in the case that substances subsequently
produced in the facility are for single/short term
administration (see also comment above) and/or for
use in specific subpopulations only (e.g. for early
clinical studies in male subjects).
We suggest that a transition period of 2 years for
implementation of the guideline is inserted for companies
deciding to follow the PDE approach. This should allow
sufficient lead time for the implementation of the PDE

approach to future compounds, products and processes
to companies. The setting of PDEs for concerned
compounds/products and potential change of the
processes will be a complex and resources-intensive
exercise.
Under the PDE- approach, we propose that a public
database for PDEs on compendial products should be
established to avoid the use of multiple PDEs for the
same compounds. This would avoid that companies
derive their „own‟ PDEs for the same compendial
compounds or similar drug products, which may lead to
different PDEs in different companies.
The current draft guideline suggests that the final
acceptability might only be given at cGMP inspections. As
decisions regarding specific measures, such as
containment or dedication, may be associated with
significant investments an earlier agency feedback, e.g.
during MAA review or at time of submission, is deemed
preferable in the light of potentially required measures
and resources that companies choosing to follow the
PDE-approach will invest.

1.Introduction Comment: With reference to our general comments, we
consider the general application of this guideline to all APIs
and medicines excessive. We strongly suggest that both the
current approach and the PDE- approach coexist with
companies being free to choose the approach that they want
to follow.
Proposed change (if any):
We propose the following rewording: “Due to the perceived
risk, certain classes of active substances have previously been
required to be manufactured in dedicated or segregated self-
contained facilities including, “certain antibiotics, certain
hormones, certain cytotoxic and certain highly active drugs”.
The current approach is as follows: Pharmaceuticals not
considered to be covered under these criteria can be
addressed by a cleaning validation process involving reduction
of the concentration of residual active substance to a level
where the maximum carryover from the total equipment train
would result in no greater than 1/1000th of the lowest clinical
dose of the contaminating substance in the maximum daily
dosage of the next product to be manufactured. This criterion
is applied concurrently with a maximum permitted
contamination of 10 ppm of the previous active substance in
the next product manufactured. Whichever of these criteria
result in the lowest carryover, constitutes the limit applied
for cleaning validation.
However, a new PDE-approach may be followed that
takes into account the available pharmacological and
toxicological profile of the substance.

For particular products or particular substances (e.g.
certain antibiotics, certain hormones, certain cytotoxics
and certain highly active drugs) the current approach
may be too restrictive. Hence, for those products and
substances a more scientific case by case approach is
warranted. for all classes of pharmaceutical substances.
In order to accommodate a more scientific approach, Chapters
3 and 5 of the GMP guideline have been revised and refer to a
“toxicological evaluation” for establishing threshold values for
risk identification for particular medicinal products. The
objective of this guideline is to present a new approach (so
called PDE approach) to review and evaluate
pharmacological and toxicological data of particular active
substances and thus enable determination of safe threshold
levels as referred to in the GMP guideline.
Both current and PDE-approach are equally acceptable.
In cases where scientific data does not support threshold
values (e.g. allergenic potential from highly sensitizing
materials) or where the risk cannot be adequately controlled
by operational and/ or technical measures, dedicated facilities
are required for manufacturing these high risk medicinal
products. ”
2. Scope Comment: With reference to our general comments, we
consider that both current approach and PDE-approach should
coexist and companies should be able to chose the approach
that they want to follow.

premises used for the manufacture of other products or active
substances.
Both current and PDE approach have the same aim i.e.
to ensure the safety of human patients and target animals
exposed to residual active substances via medicinal products
as well as consumers potentially exposed to residual active
substances in products derived from treated food producing
animals. This document aims to present a new approach (so
called PDE- approach) for deriving a scientifically based
threshold value for individual active substances to be applied
for risk identification. This guideline also outlines how the data
on which the threshold value is derived should be presented in
the risk assessment report in order to achieve a clear and
harmonious approach across pharmaceutical companies
choosing to follow the new PDE approach. Both current
and PDE-approach are acceptable”.
Line 102 Comment: Other synonyms for PDE are used by other
authorities and in the public literature, such as “acceptable
daily exposure” (ADE) and “acceptable daily intake” (ADI) …
Proposed change: Include these synonyms for a better
understanding. The use of other synonyms should be allowed,
e.g. in already existing documents/risk assessment reports.

individuals, while others show high variability particularly
related to pharmacokinetic effects (e.g. due to genetic
polymorphism in cytochrome P450 enzyme activity, or in case
of renal or hepatic impairment) and adverse effects
(idiosyncratic reactions etc.). This should be taken into

This approach from ICH Q3C (R4) is adequate for chemicals
with generally no human data available. However, a more
specific and more detailed approach for pharmaceutical
substances would make sense, for which in many cases the
pharmacodynamic effects are the critical effects in the
calculation of the PDE. In many cases NOELs for the
pharmacological effects are not available. Data from clinical
studies (at effect levels) and dosing recommendations from
prescribing information have to be used for the calculation of
the PDE. When using the lowest clinical dose (with known
effects) from this data as the LOEL, and the proposed factor of
10, this would clearly differ from the current approach or
using 1/1000th of the lowest clinical dose. Both factors are
arbitrary defaults that may be too high or too low for many
compounds. However the adjustment factor to estimate the
NOEL from the lowest clinical dose is the most critical in the
calculation of the PDE. It is therefore suggested to give a
more detailed guide on the adjustment factor to be used. This
adjustment factor should be depending on the mode of
action/therapeutic class, the desired pharmacological effects
as well as undesired pharmacological effects, and the adverse
effects typically observed in humans including their dose
response and severity.

1. Rechtsgrundlage
Nach § 35c Abs. 1 SGB V werden dem Gemeinsamen Bundesausschuss (G-BA) die
Empfehlungen der vom BMG berufenen Expertengruppen zum Stand der wissenschaftlichen
Erkenntnisse über die Anwendung von zugelassenen Arzneimitteln für Indikationen oder
Indikationsbereiche, für die sie nach dem Gesetz über den Verkehr mit Arzneimitteln
(Arzneimittelgesetz/AMG) nicht zugelassen sind, zur Beschlussfassung zugeleitet.
Der Gemeinsame Bundesausschuss soll in der Richtlinie nach § 92 Abs. 1 Satz 2 Nr. 6
SGB V (Arzneimittel-Richtlinie) festlegen, welche zugelassenen Arzneimittel in nicht
zugelassenen Anwendungsgebieten verordnungsfähig sind.
Die Regelungen der Verordnungsfähigkeit von zugelassenen Arzneimitteln in nicht
zugelassenen Anwendungsgebieten (sog. Off-Label-Use) sind in Abschnitt K der
Arzneimittel-Richtlinie (AM-RL) aufgeführt. Zum Zwecke der Konkretisierung dieses
Abschnittes K ist eine Anlage VI angefügt.
In § 30 Abs. 1 des Abschnittes K der AM-RL sind die Voraussetzungen für eine
Verordnungsfähigkeit von zugelassenen Arzneimitteln im Off-Label-Use aufgeführt.
Voraussetzungen sind
1. dass die Expertengruppen mit Zustimmung des pharmazeutischen Unternehmers eine
positive Bewertung zum Stand der wissenschaftlichen Erkenntnis über die Anwendung
dieser Arzneimittel in den nicht zugelassenen Indikationen oder Indikationsbereichen als
Empfehlung abgegeben haben
und
2. dass der G-BA die Empfehlung in Anlage VI Teil A übernommen hat.
In Teil A der Anlage VI werden somit verordnungsfähige Arzneimittel in zulas-
sungsüberschreitenden Anwendungen (Off-Label-Use) aufgelistet (gemäß § 30 Abs. 1 AM-
RL), sowie die Angaben zur ggf. notwendigen Verlaufsdokumentation (gemäß § 30 Abs. 4
AM-RL). Notwendige Voraussetzungen dafür sind die Zustimmung des pharmazeutischen
Unternehmers sowie eine positive Empfehlung durch die Expertengruppe. Bei der
Umsetzung der Empfehlungen der Expertengruppe prüft der Gemeinsame
Bundesausschuss, ob die Anwendung des Wirkstoffes in der Off-Label-Indikation
medizinisch notwendig und wirtschaftlich ist.
§ 30 Abs. 5 des Abschnitts K der AM-RL regelt, wann eine Verordnungsfähigkeit von
Arzneimitteln im Off-Label-Use nicht gegeben ist. Für Arzneimittel, deren Anwendung in nicht
zugelassenen Indikationen oder Indikationsbereichen nach Bewertung der Expertengruppen
nicht dem Stand der wissenschaftlichen Erkenntnis entspricht oder die medizinisch nicht
notwendig oder unwirtschaftlich sind, ist eine Verordnungsfähigkeit dementsprechend nicht
gegeben. Diese werden in Anlage VI Teil B der AM-RL aufgeführt.
2. Eckpunkte der Entscheidung
Die Firma Grifols Deutschland GmbH hat nachträglich zur Beschlussfassung des G-BA vom
18. April 2013 über die Umsetzung der Empfehlung der Expertengruppe Off-Label zu
„Intravenöse Immunglobuline (IVIG) bei Polymyositis und bei Dermatomyositis“ die
Anerkennung des bestimmungsgemäßen Gebrauchs nach § 84 AMG ihrer IVIG-haltigen
Arzneimittel zur Anwendung bei Polymyositis und bei Dermatomyositis erklärt.
Die Änderung der Arzneimittel-Richtlinie in Bezug auf die Wiedergabe der Zustimmungen
pharmazeutischer Unternehmer zum Off-Label-Use intravenöser Immunglobuline (IVIG) bei

Polymyositis im Erwachsenenalter (Add-on-Behandlung bei therapieresistentem Verlauf) und
bei Dermatomyositis im Erwachsenenalter (Add-on-Behandlung bei therapieresistentem
Verlauf) dient daher der Veröffentlichung der zustimmenden Erklärung des betroffenen
pharmazeutischen Unternehmers Grifols Deutschland GmbH gemäß § 35c Abs. 1 Satz 7
SGB V.
3. Bürokratiekostenermittlung
Durch den vorgesehenen Beschluss entstehen keine neuen bzw. geänderten
Informationspflichten für Leistungserbringer im Sinne von Anlage II zum 1. Kapitel VerfO
und dementsprechend keine Bürokratiekosten.
4. Verfahrensablauf
Mit Schreiben vom 10. Dezember 2013 hat die Firma Grifols Deutschland GmbH die
Anerkennung des bestimmungsgemäßen Gebrauchs nach § 84 AMG ihrer IVIG-haltigen
Arzneimittel zur Anwendung bei Polymyositis und bei Dermatomyositis erklärt.
Über die Haftungsübernahmeerklärung wurde dahingehend beraten, dass dieser durch eine
entsprechende Änderung der Anlage VI Teil A Rechnung zu tragen ist.

Anlage VI in Teil A Ziffer XII
Für die Änderung der Arzneimittel-Richtlinie in diesem Punkt ist es nicht erforderlich, ein
Stellungnahmeverfahren nach § 92 Abs. 3a SGB V durchzuführen. Sinn und Zweck der
Regelung zur Durchführung von Stellungnahmeverfahren ist es in erster Linie, dass den
anhörungsberechtigten Organisationen Gelegenheit gegeben wird, zu der Sachgerechtigkeit
einer Richtlinienänderung Stellung nehmen zu können. Dies ist in Bezug auf die Umsetzung
der Empfehlung der Expertengruppe Off-Label zu „Intravenöse Immunglobuline (IVIG) bei
Polymyositis und bei Dermatomyositis“ in die AM-RL geschehen. Mit Schreiben vom
2. Oktober 2012 wurde den Stellungnahmeberechtigten nach § 92 Abs. 3a SGB V bis zum
5. November 2012 Gelegenheit zur Stellungnahme zu der entsprechenden
Richtlinienänderung gegeben. Zur Änderung der AM-RL hinsichtlich der Umsetzung der in
Rede stehenden Empfehlung der Expertengruppe Off-Label wurde ein
Stellungnahmeverfahren durchgeführt; Einwände inhaltlicher Art wurden von den betroffenen
Herstellern nicht geltend gemacht. Auch die Firma Grifols Deutschland GmbH erhebt keine
Einwände dieser Art. Durch die Berücksichtigung ihrer zustimmenden Erklärung nach § 35c
Abs. 1 Satz 7 SGB V will sie vielmehr erreichen, dass auch ihre Präparate nach den
Bestimmungen der AM-RL zum zulässigen Off-Label-Use verordnungsfähig gestellt werden.
Da es sich bei der Erklärung, dass das betreffende Anwendungsgebiet als

bestimmungsgemäßer Gebrauch akzeptiert wird, um eine herstellerindividuelle
Willenserklärung über den Umfang der den Hersteller nach dem AMG treffenden
Gefährdungshaftung handelt, deren Abgabe allein im Verantwortungsbereich des jeweiligen
Herstellers liegt, ist eine erneute Anhörung auch der anderen Hersteller nicht erforderlich.

Vom 20. März 2014
Der Gemeinsame Bundesausschuss hat in seiner Sitzung am 20. März 2014 beschlossen,
die Richtlinie über die Verordnung von Arzneimitteln in der vertragsärztlichen Versorgung
(Arzneimittel-Richtlinie) in der Fassung vom 18. Dezember 2008 / 22. Januar 2009 (BAnz.
Nr. 49a vom 31. März 2009), zuletzt geändert am 20. Mai 2014 (BAnz AT 16.06.2014 B2),
wie folgt zu ändern:
I. In Anlage VI der Arzneimittel-Richtlinie wird in Teil A nach der Ziffer XX eine Ziffer XXI
wie folgt eingefügt:
„XXI. Cisplatin in Kombination mit Gemcitabin bei fortgeschrittenen Karzinomen der
Gallenblase und –wege
1. Hinweise zur Anwendung von Cisplatin in Kombination mit Gemcitabin bei
fortgeschrittenen Karzinomen der Gallenblase und –wege gemäß § 30 Absatz 2 AM-RL
a) Nicht zugelassenes Anwendungsgebiet (Off-Label-Indikation):
Systemische, medikamentöse Erstlinienchemotherapie mit Cisplatin plus
Gemcitabin bei Patienten mit lokal fortgeschrittenen, inoperablen, rezidivierten oder
metastasierten Karzinomen der Gallenblase und/oder Gallenwege.
b) Angabe des Behandlungsziels:
Verlängerung der Überlebenszeit.
c) Welche Wirkstoffe sind für die entsprechende Indikation zugelassen?

d) Nennung der speziellen Patientengruppe:
Medikamentöse palliative Erstlinienchemotherapie bei geeigneten Patienten mit
lokal fortgeschrittenen, inoperablen, rezidivierten oder metastasierten Karzinomen
der Gallenblase und/oder Gallenwege bei einem Allgemeinzustand gemäß
ECOG 0-2, ohne Hirnmetastasen und einer ausreichenden Funktion von
Hämatopoese, Leber und Niere.
Patienten mit Abstand von mindestens 6 Monaten zur vorherigen adjuvanten
Chemotherapie und Patienten mit vorheriger niedrigdosierter radiosensibilisierender
Chemotherapie in Kombination mit Radiotherapie können eingeschlossen werden.
e) Nennung der Patienten, die nicht behandelt werden sollen:
Die in den Fachinformationen von Cisplatin und Gemcitabin genannten
Warnhinweise und Kontraindikationen sind zu beachten.

f) Dosierung:
Cisplatin 25 mg/m2 Körperoberfläche (KOF) i. v. in 1000 ml 0,9 % NaCl-Lösung als
einstündige Infusion gefolgt von 500 ml 0,9 % NaCl-Lösung über 90 Minuten i. v.;
Gemcitabin 1000 mg/m2 KOF i. v. in 250-500 ml 0,9 % NaCl-Infusion über 30
Minuten an den Tagen 1 und 8;
Zykluswiederholung am Tag 22.
In Abhängigkeit von der Toxizität der Behandlung sind ggf. Intervallverlängerungen
oder Dosisreduktionen erforderlich.
Die zur Anwendung von Cisplatin und Gemcitabin in den Fachinformationen
festgehaltenen Bedingungen bezüglich der Patienteneignung und der
Medikamentenanwendung (u. a. bezüglich der Vorsichts-, Begleit- und
Kontrollmaßnahmen vor, während und nach der Behandlung) sind zu
gewährleisten.
g) Behandlungsdauer, Anzahl der Zyklen:
Geprüft für maximal 8 Zyklen bzw. 24 Wochen.
h) Wann sollte die Behandlung abgebrochen werden?
Die Behandlung sollte abgebrochen werden bei Tumorprogress oder inakzeptabler
Toxizität.
i) Nebenwirkungen/Wechselwirkungen, wenn diese über die zugelassene
Fachinformation hinausgehen oder dort nicht erwähnt sind:
Die Fachinformationen von Cisplatin und Gemcitabin sind zu beachten.
Nach der Berufsordnung der Ärzte sind Verdachtsfälle von Nebenwirkungen, deren
Art, Ausmaß oder Ergebnis von den in der Fachinformation genannten abweichen,
der Arzneimittelkommission der deutschen Ärzteschaft (AkdÄ) bzw. der
zuständigen Bundesoberbehörde zu melden. Dies gilt auch für Arzneimittel, die im
Off-Label-Use eingesetzt werden. Auch für Patienten besteht die Möglichkeit,
Nebenwirkungen direkt an die Bundesoberbehörden zu melden.
j) Weitere Besonderheiten:
Die Kombination Cisplatin/Gemcitabin ist mit erheblicher Toxizität verbunden und
sollte nur von Fachärzten/innen für Innere Medizin, Hämatologie und Onkologie
oder bei gastrointestinalen Karzinomen auch von Fachärzten/innen für Innere
Medizin und Gastroenterologie mit ausreichender Erfahrung in der Anwendung
dieser Medikamentenkombination angewandt werden.
k) Zustimmung der pharmazeutischen Unternehmer:
Die folgenden pharmazeutischen Unternehmer haben für ihre Cisplatin-haltigen
und/oder Gemcitabin-haltigen Arzneimittel eine Anerkennung des
bestimmungsgemäßen Gebrauchs abgegeben (Haftung des pharmazeutischen
Unternehmers), sodass ihre Arzneimittel für die vorgenannte Off-Label-Indikation
verordnungsfähig sind:
Accord Healthcare GmbH, Actavis Deutschland GmbH & Co. KG, APOCARE
PHARMA GmbH, axios Pharma GmbH, betapharm Arzneimittel GmbH, Bhardwaj
Pharma GmbH, Caduceus Pharma Ltd., Cancernova GmbH onkologische
Arzneimittel, cell pharm GmbH, EurimPharm Arzneimittel GmbH, Fresenius Kabi
Deutschland GmbH, Fresenius Kabi Oncology Plc, HAEMATO PHARM AG,
Heumann Pharma GmbH & Co. Generica KG, Hexal AG, HIKMA Farmacêutica

1. Rechtsgrundlage
Nach § 35c Abs. 1 SGB V werden dem Gemeinsamen Bundesausschuss (G-BA) die
Empfehlungen der vom BMG berufenen Expertengruppen zum Stand der wissenschaftlichen
Erkenntnisse über die Anwendung von zugelassenen Arzneimitteln für Indikationen oder
Indikationsbereiche, für die sie nach dem Gesetz über den Verkehr mit Arzneimitteln
(Arzneimittelgesetz/AMG) nicht zugelassen sind, zur Beschlussfassung zugeleitet.
Der Gemeinsame Bundesausschuss soll in der Richtlinie nach § 92 Abs. 1 Satz 2 Nr. 6
SGB V (Arzneimittel-Richtlinie) festlegen, welche zugelassenen Arzneimittel in nicht
zugelassenen Anwendungsgebieten verordnungsfähig sind.
Die Regelungen der Verordnungsfähigkeit von zugelassenen Arzneimitteln in nicht
zugelassenen Anwendungsgebieten (sog. Off-Label-Use) sind in Abschnitt K der
Arzneimittel-Richtlinie (AM-RL) aufgeführt. Zum Zwecke der Konkretisierung dieses
Abschnittes K ist eine Anlage VI angefügt.
In § 30 Abs. 1 des Abschnittes K der AM-RL sind die Voraussetzungen für eine
Verordnungsfähigkeit von zugelassenen Arzneimitteln im Off-Label-Use aufgeführt.
Voraussetzungen sind
1. dass die Expertengruppen mit Zustimmung des pharmazeutischen Unternehmers eine
positive Bewertung zum Stand der wissenschaftlichen Erkenntnis über die Anwendung
dieser Arzneimittel in den nicht zugelassenen Indikationen oder Indikationsbereichen als
Empfehlung abgegeben haben
und
2. dass der G-BA die Empfehlung in Anlage VI Teil A übernommen hat.
In Teil A der Anlage VI werden somit verordnungsfähige Arzneimittel in
zulassungsüberschreitenden Anwendungen (Off-Label-Use) aufgelistet (gemäß § 30 Abs. 1
AM-RL), sowie die Angaben zur ggf. notwendigen Verlaufsdokumentation (gemäß § 30 Abs.
4 AM-RL). Notwendige Voraussetzungen dafür sind die Zustimmung des pharmazeutischen
Unternehmers sowie eine positive Empfehlung durch die Expertengruppe. Bei der
Umsetzung der Empfehlungen der Expertengruppe prüft der Gemeinsame
Bundesausschuss, ob die Anwendung des Wirkstoffes in der Off-Label-Indikation
medizinisch notwendig und wirtschaftlich ist.
§ 30 Abs. 5 des Abschnitts K der AM-RL regelt, wann eine Verordnungsfähigkeit von
Arzneimitteln im Off-Label-Use nicht gegeben ist. Für Arzneimittel, deren Anwendung in nicht
zugelassenen Indikationen oder Indikationsbereichen nach Bewertung der Expertengruppen
nicht dem Stand der wissenschaftlichen Erkenntnis entspricht oder die medizinisch nicht
notwendig oder unwirtschaftlich sind, ist eine Verordnungsfähigkeit dementsprechend nicht
gegeben. Diese werden in Anlage VI Teil B der AM-RL aufgeführt.

2. Eckpunkte der Entscheidung
Mit Briefdatum vom 17. Juli 2013 ist dem G-BA durch die Geschäftsstelle Kommissionen des
Bundesinstituts für Arzneimittel und Medizinprodukte (BfArM) eine Bewertung der
Expertengruppe Off-Label im Fachbereich Onkologie nach § 35c Abs. 1 SGB V zum Stand
der wissenschaftlichen Erkenntnis zur Anwendung von Cisplatin in Kombination mit
Gemcitabin bei fortgeschrittenen Karzinomen der Gallenblase und –wege zur Umsetzung in
der Arzneimittel-Richtlinie zugeleitet worden. Die entsprechende Bewertung ist auch auf den
Internetseiten des BfArM, www.bfarm.de, veröffentlicht.
Die vom Unterausschuss Arzneimittel eingesetzte Arbeitsgruppe Off-Label-Use hat die
Bewertung der Expertengruppe zur Anwendung von Cisplatin in Kombination mit Gemcitabin
bei fortgeschrittenen Karzinomen der Gallenblase und –wege überprüft.
Die Expertengruppe kommt zu folgendem Fazit:
„Diese systemische Cisplatin/Gemcitabin-Kombination ist die bislang einzige medikamen-
töse Phase-III-Studien-geprüfte, palliative Erstlinienchemotherapie, die bei geeigneten
Patienten mit inoperablem bzw. metastasiertem Gallenblasen- bzw. -wegskarzinomen mit
einer Verlängerung der Überlebenszeit verbunden ist. Im Kontrollarm erhielten die Patienten
eine Monotherapie mit Gemcitabin.
Der Unterausschuss Arzneimittel ist nach Würdigung der Bewertung der Expertengruppe
und der Beratungen der Arbeitsgruppe Off-Label-Use zu dem Ergebnis gekommen, dass die
sachgerechte Bearbeitung des erteilten Auftrages plausibel ist und die Empfehlung durch
folgende Ergänzung der Anlage VI in Teil A
„XXI. Cisplatin in Kombination mit Gemcitabin bei fortgeschrittenen Karzinomen der
Gallenblase und –wege
umzusetzen.
Aus dem Stellungnahmeverfahren haben sich keine Änderungs- oder Ergänzungshinweise
ergeben, insofern stellen die vorliegenden Tragenden Gründe den aktuellen Stand der
Zusammenfassenden Dokumentation dar.
3. Bürokratiekostenermittlung
Durch den vorgesehenen Beschluss entstehen keine neuen bzw. geänderten
Informationspflichten für Leistungserbringer im Sinne von Anlage II zum 1. Kapitel VerfO und
dementsprechend keine Bürokratiekosten.
4. Verfahrensablauf
Zur Vorbereitung einer Beschlussempfehlung zur Einleitung eines Stellungnahmeverfahrens
hat der Unterausschuss Arzneimittel eine Arbeitsgruppe beauftragt, die sich aus den von den
Spitzenorganisationen der Leistungserbringer benannten Mitgliedern, der vom GKV-
Spitzenverband benannten Mitglieder sowie Vertreter(innen) der Patientenorganisationen
zusammensetzt.
In der Sitzung am 5. November 2013 wurde im Unterausschuss Arzneimittel die Bewertung
der Expertengruppe zur Anwendung von Cisplatin in Kombination mit Gemcitabin bei
fortgeschrittenen Karzinomen der Gallenblase und –wege als Empfehlung angenommen und
deren Umsetzung in die Arzneimittel-Richtlinie abschließend beraten und konsentiert.

Der Unterausschuss hat in der Sitzung am 5. November 2013 nach § 10 Abs. 1, 1. Kapitel
der Verfahrensordnung des G-BA die Einleitung des Stellungnahmeverfahrens einstimmig
beschlossen.
Der Unterausschuss wurde in seiner Sitzung am 11. Februar 2014 über den Eingang der
Stellungnahme der Bundesärztekammer (BÄK) informiert. Da die BÄK ausweislich ihrer
eingereichten Stellungnahme keine Ergänzungs- oder Änderungshinweise zur geplanten
Umsetzung der Empfehlung der Expertengruppe in die Arzneimittel-Richtlinie hatte, konnte
von der Durchführung eines mündlichen Anhörungsverfahrens ausnahmsweise abgesehen
werden.
Der Unterausschuss „Arzneimittel“ hat die Beschlussvorlage in der Sitzung am 11. Februar
2014 ohne weitere Änderungen konsentiert.

5. Bewertungsverfahren
Der Gemeinsame Bundesausschuss soll in der Arzneimittel-Richtlinie festlegen, welche
zugelassenen Arzneimittel in nicht zugelassenen Anwendungsgebieten verordnungsfähig
sind. Hierzu werden dem Gemeinsamen Bundesausschuss (G-BA) die Empfehlungen der
Expertengruppen Off-Label zum Stand der wissenschaftlichen Erkenntnis über die
Anwendung von zugelassenen Arzneimitteln für Indikationen oder Indikationsbereiche, für
die sie nach dem Gesetz über den Verkehr mit Arzneimitteln (Arzneimittelgesetz/AMG) nicht
zugelassen sind, zur Beschlussfassung zugeleitet.
5.1 Bewertungsgrundlage
Die Expertengruppe Off-Label im Fachbereich Onkologie kommt in ihrer Bewertung zur
Anwendung von Cisplatin in Kombination mit Gemcitabin bei fortgeschrittenen Karzinomen
der Gallenblase und –wege zu folgendem Fazit (Empfehlung an den G-BA); in der Fassung:

12.1 Off-Label Indikationen
Systemische, medikamentöse Erstlinienchemotherapie mit Cisplatin plus Gemcitabin bei
Patienten mit lokal fortgeschrittenen, inoperablen, rezidivierten oder metastasierten
Karzinoms der Gallenblase und/oder Gallenwege
12.2 Angabe des Behandlungsziels
Verlängerung der Überlebenszeit
12.3 Welche Wirkstoffe sind für die entsprechende Indikation zugelassen?

12.4 Nennung der speziellen Patientengruppe
Medikamentöse palliative Erstlinienchemotherapie bei geeigneten Patienten mit lokal
fortgeschrittenen, inoperablen, rezidivierten oder metastasierten Karzinomen der Gallenblase
und/oder Gallenwege bei einem Allgemeinzustand gemäß ECOG 0 - 2, ohne
Hirnmetastasen und einer ausreichenden Funktion von Hämatopoese, Leber und niere.
Patienten mit Abstand von mindestens 6 Monaten zur vorherigen adjuvanten Chemo-
therapie und Patienten mit vorheriger niedrig-dosierter radiosensiblisierender Chemo-
therapie in Kombination mit Radiotherapie können eingeschlossen werden.
12.5 Ggf. Nennung der Patienten, die nicht behandelt werden sollen
Die in den Fachinformationen von Cisplatin und Gemcitabin genannten Warnhinweise und
Kontraindikationen sind zu beachten.
12.6 Dosierung (z.B. Mono- oder Kombinationstherapie, gleichzeitig, zeitversetzt,
Abstand usw.)
Dosierung:
Cisplatin 25 mg/m2 KOF i. v. in 1000 ml 0,9 %NaCL-Lösung als einstündige Infusion gefolgt
von 500 ml 0,9 % NaCl-Lösung über 90 Minuten i. v.;
Gemcitabin 1000 mg/m2 KOF i. v. in 250-500 ml 0,9 % NaCL-Infusion über 30 Minuten an
den Tagen 1 und 8;
Zykluswiederholung am Tag 22.

In Abhängigkeit von der Toxizität der Behandlung sind ggf. Intervallverlängerungen oder
Dosisreduktionen erforderlich.
Die zur Anwendung von Cisplatin und Gemcitabin in den Fachinformationen festgehaltenen
Bedingungen bezüglich der Patienteneignung und der Medikamentenanwendung (u. a.
bezüglich der Vorsichts-, Begleit- und Kontrollmaßnahmen vor, während und nach der
Behandlung) sind zu gewährleisten.
12.7 Behandlungsdauer, Anzahl der Zyklen
Geprüft für maximal 8 Zyklen bzw. 24 Wochen
12.8 Wann sollte die Behandlung abgebrochen werden?
Die Behandlung sollte abgebrochen werden bei Tumorprogress oder inakzeptabler Toxizität.
12.9 Nebenwirkungen / Wechselwirkungen, wenn diese über die zugelassene
Fachinformation hinausgehen oder dort nicht erwähnt sind
Die Fachinformationen von Cisplatin und Gemcitabin sind zu beachten.
12.10 Weitere Besonderheiten
Die Kombination Cisplatin/Gemcitabin ist mit erheblicher Toxizität verbunden und sollte nur
von Fachärzten/innen für Innere Medizin, Hämatologie und Onkologie oder bei
gastrointestinalen Karzinomen auch von Fachärzten/innen für Innere Medizin und
Gastroenterologie mit ausreichender Erfahrung in der Anwendung dieser
Medikamentenkombination angewandt werden.
13. Bemerkungen
Cisplatin / Gemcitabin ist eine Standardkombination in der internistischen Onkologie.“

5.2 Bewertungsentscheidung
Die Umsetzung der Empfehlung erfolgt durch Ergänzung der Anlage VI in Teil A
um
„XXI. Cisplatin in Kombination mit Gemcitabin bei fortgeschrittenen Karzinomen der
Gallenblase und –wege.
Im Vergleich zum ergänzenden Fazit der Expertengruppe wird hinsichtlich
Nebenwirkungen/Wechselwirkungen, wenn diese über die der aktuellen Fachinformation für
die zugelassenen Indikationen hinausgehen oder dort nicht erwähnt sind, darauf
hingewiesen, dass nach der Berufsordnung der Ärzte Verdachtsfälle von Nebenwirkungen,
deren Art, Ausmaß oder Ergebnis von den in der Fachinformation genannten abweichen, der
AkdÄ bzw. der zuständigen Bundesoberbehörde zu melden sind und für Patienten die
Möglichkeit besteht, Nebenwirkungen direkt an die Bundesoberbehörden zu melden.

6. Dokumentation des gesetzlich vorgeschriebenen Stellungnahmeverfahrens
Gemäß § 92 Abs. 3a SGB V wird den Sachverständigen der medizinischen und
pharmazeutischen Wissenschaft und Praxis sowie den für die Wahrnehmung der
wirtschaftlichen Interessen gebildeten maßgeblichen Spitzenorganisationen der
pharmazeutischen Unternehmer, den betroffenen pharmazeutischen Unternehmern, den
Berufsvertretungen der Apotheker und den maßgeblichen Dachverbänden der
Ärztegesellschaften der besonderen Therapierichtungen auf Bundesebene Gelegenheit zur
Stellungnahme zu geben.

Ausweislich ihrer Stellungnahme hat die BÄK keine Ergänzungs- oder Änderungshinweise.
7. Anerkennung des bestimmungsgemäßen Gebrauchs nach § 84 AMG
Im Nachgang zum Stellungnahmeverfahren wurden auf Basis einer seitens der
Geschäftsstelle Kommissionen des BfArM übermittelten Adressliste die pharmazeutischen
Unternehmer, die eine Zulassung für ein Cisplatin- und / oder Gemcitabin-haltiges
Arzneimittel besitzen, angeschrieben und um Anerkennung des bestimmungsgemäßen
Gebrauchs ihrer Cisplatin- und / oder Gemcitabin-haltigem Arzneimittel zur Anwendung bei
fortgeschrittenen Karzinomen der Gallenblase und –wege gebeten.
Die pharmazeutischen Unternehmer, die schriftlich eine Anerkennung des be-
stimmungsgemäßen Gebrauchs ihrer Arzneimittel nach § 84 AMG erklärt haben, werden in
der Arzneimittel-Richtlinie entsprechend namentlich genannt.
