Since last year the European Commission (EC) has held informal information meetings with
pharmaceutical industry associations around the implementation of the falsified medicinal directive
(FMD) and the issue of the import of active pharmaceutical ingredients (APIs) in particular. The
meeting was a follow-up to the last meeting of 2 September 2013.
The meeting was short in the absence of immediate issues related to import of APIs and risk of shortages.
Listing of countries with GMP rules at least equivalent to EU GMP (=waiver 1)
No additional countries applied for waiver 1 since the last meeting.
The Commission informed that the on-site audit in Brazil took place by end of September together
with representatives of two Member States. Although several parts of Brazilian’s systems can be
regarded as equivalent to EU GMP, some issues need remediation. The Commission will request Brazil
to provide an action plan within the next 6 months to 1 year. A re-inspection within a 1-year time
period is expected.
Issuance of the written confirmation (WC)
- India: as of today, it was reported that 254 WCs were issued. WC can be downloaded and printed
under the following link (http://www.cdsco.nic.in/WC_scanned_copies.htm).
Indian representatives visited the EC in September to further discuss the ongoing WC
implementation process. According to the Commission, India seems very committed.
- China: Representatives from the Chinese Food and Drug Administration (CFDA) joined an EU-China
workshop organised in September, also including industry representatives. The workshop
confirmed that China is working on the WC implementation: up to end of August, 322 WCs were
issued, covering 167 Chinese API manufacturers and a total of 524 APIs.
Written confirmation and non-compliance
The Commission informed that in case of non-compliances reported by Third Countries or Member States
(i.e. via the alert network system), the impacted WCs need to be considered as suspended, but will not be
revoked. Member States will be informed by the EC and advised not to accept the impacted materials
anymore. In case of custom controls performed by Member States, the import of these materials will most
probably be denied. Re-inspection of the impacted manufacturers needs to be planned in these cases.

As GMP non-compliances are not considered public information, there is, so far, no information
process in place to inform industry. Third Country API manufacturers impacted by the non-compliance
are supposed to inform their customers directly.
Upon request from the Industry representatives, the Commission will evaluate together with EMA and
Member States if non-compliances and WC suspensions could be made public, i.e. similar to
information provided on the EDQM homepage about suspended/withdrawn CEPs.
Related to this topic, the Commission informed that it is planned to provide information about EU
Authority Inspections on the EU GMP database in future, so that ongoing non-compliances due to EU
Authority inspections would become visible to the public.
The Commission also informed that, currently, 2 non-compliances are followed up with the respective
third country’s authorities.
Transposition of EU law by Member States
To date, 5 countries have not yet transposed the Falsified Medicines Directive; the Commission is
following up on this. Countries which did implement the Directive can be found on Sanco’s website.
Feedback from Industry
The results of a survey performed among the EGA Members were presented to the Commission.

Forty percent of the 10 companies answering the survey reported to have all their materials covered
with valid WC at this point in time. Sixty percent were still missing some WCs, mainly from the Third
countries India, China and Turkey. Nevertheless, shortages are for the time being not expected, mainly
due to implemented bridging stocks.
EFPIA and AESGP also confirmed that immediate drug shortages had so far not been reported by their
members.
EGA reported that, in one case, the UK Authority was successfully asked to issue a waiver 2.
A main issue within Industry is the validity of the WCs. EGA Members reported that validity show a
high variability, with some issued WCs already expiring by end of 2013 or beginning of 2014.
So far, the processes for WC renewal are unclear and represent an increased issue of predictability.
EFPIA and AESGP informed that, so far, no waivers/exceptions had been reported regarding atypical
APIs, this topic being still open for some materials.
Next steps
The next industry-EC meeting on this topic is scheduled on 27 November at 14.30 hours.

Not much news since the last meeting, with the exception that Singapore is changing its legislation
possibly in view of applying for listing.
Issuance of the written confirmation (WC)
- India: as of today, it was reported that 238 WCs were issued. The Indian Authorities have posted
the scanned copies of the WC issued so that they could be downloaded and printed in case the
real copy is not with the consignment (http://www.cdsco.nic.in/WC_scanned_copies.htm).
The Commission tries to encourage all other third countries’ authorities to adopt a similar and
transparent approach of publishing scanned WCs.
- China: No information communicated by Chinese regulatory authorities during the summer
despite several endeavours from the Commission.
- South Korea: 54 WCs issued
Written confirmation and non-compliance
The Commission was made aware of sites deemed non-compliant by EU inspectors or the EDQM
during GMP inspection although a WC had been issued for these sites. The Commission said that it is
liaising with the respective third country’s authorities so that there is a follow-up. In any case there is a
follow-up by the EU inspectors post-inspection.
In case of similar cases, industry is asked to inform the EMA or the Commission and to give as many
details as possible on the cases, including full address of the API manufacturing plant, as such details
are of critical use for inspections.

Waiver 2
Eight countries (Spain, Italy, United Kingdom, Ireland, Germany, Romania, France and Malta) have
communicated to the Commission that they will make use of waiver 2 (as needs be).
Five countries will not use waiver 2 for the time being: Belgium, Sweden, Norway, Czech Republic and
Liechtenstein.

The next industry-EC meeting on this topic is scheduled on 18 October at 10.30 hours.

Anforderung an den Import von Wirkstoffen aus Drittländern
zur Arzneimittelherstellung in Deutschland
Die Richtlinie 2011/62/EU (sog. „Arzneimittel-Fälschungsrichtlinie“) zur Änderung der Richtli-
nie 2001/83/EG führt europaweit Anforderungen an den Import von Wirkstoffen ein.
Nach Artikel 46b Absatz 2 der Richtlinie dürfen Wirkstoffe nur dann importiert werden, wenn
sie von einer Bestätigung der zuständigen Behörde des Herstellungslandes begleitet wer-
den. Für diese Bestätigung hat die EU-Kommission ein Format („template“) erarbeitet und
ein Q&A-Papier veröffentlicht.
Nach Artikel 46b Absatz 4 der Richtlinie kann die genannte Anforderung für einen bestimm-
ten Zeitraum ausgesetzt werden, wenn eine Bestätigung über die Gute Herstellungspraxis
auf der Grundlage eines EU-Mitgliedsstaates basierend auf einer von ihm durchgeführten
Inspektion vorliegt.
Die Regelungen der genannten Richtlinie finden sich im deutschen Arzneimittelgesetz
(§ 72a AMG) wieder. Hier sind folgende Möglichkeiten aufgeführt, die Voraussetzungen für
den Import von Wirkstoffen zu bescheinigen:
1. Bestätigung der Einhaltung der guten Herstellungspraxis durch die für den
Herstellerbetrieb im Drittland zuständigen Behörde
Aus der Bestätigung muss hervorgehen, dass der Herstellungsbetrieb die Wirkstoffe
nach Standards der Guten Herstellungspraxis (GMP) herstellt, die denen von der
Union festgelegten Standards zumindest gleichwertig sind.
Es wird somit eine Vergleichbarkeit bestätigt, und nicht die Anwendung der EU-GMP
Standards selbst. Dies geht auch aus dem Q&A-Papier der EU-Kommission (Antwor-
ten auf die Fragen 6-8) hervor.
2. Bestätigung durch die im Drittland zuständige Behörde über die Durchführung
von Inspektionen im Herstellungsbetrieb
Aus der Bestätigung muss hervorgehen, dass der Herstellungsbetrieb regelmäßigen
Seite 2 von 2 Kontrollen und Maßnahmen zur wirksamen Durchsetzung der Guten Herstellungs-
praxis unterliegt, einschließlich wiederholter und unangekündigter Inspektionen.
Diese Inspektionen sollen somit nicht nur einmalig, sondern wiederholt durchgeführt
werden und auch unangekündigt erfolgen. Unangekündigte Inspektionen sind somit
eine von verschiedenen Möglichkeiten einer regelmäßigen Überwachung. Damit sol-
len auch hinsichtlich der Überwachungstätigkeiten Standards angewendet werden,
die denen innerhalb der Europäischen Union gleichwertig sind.
3. Anerkennung von Bestätigungen anderer EU-Staaten über die Einhaltung der
guten Herstellungspraxis in Wirkstoffherstellungsbetrieben im Drittland
§ 72a Absatz 1 Satz 2 Nummer 1 AMG sieht in solchen Fällen, in denen kein Zertifi-
kat der zuständigen Behörde des Herstellungslandes vorliegt, vor, dass die für den
Importeur zuständige Behörde eine GMP-Bescheinigung ausstellt. Hierzu muss sie
oder eine andere zuständige Behörde eines EU/EWR-Staates sich regelmäßig im
Herstellungsland vergewissert haben, dass die Grundregeln bei der Herstellung der
Wirkstoffe eingehalten werden. Diese Regelung besteht bereits seit Jahren und gilt
unverändert fort.
4. Anerkennung der Einfuhr im „öffentlichen Interesse“
Diese Möglichkeit (§ 72a Absatz 1 Satz 1 Nummer 3 AMG) ist eine Ausnahmerege-
lung und liegt als Einzelfallentscheidung in der Kompetenz der Länder. Von ihr kann
nur dann Gebrauch gemacht werden, wenn die unter den Punkten 1 bis 3 aufgeführ-
ten Vorgaben nicht eingehalten werden können und ein Versorgungsmangel zu er-
warten ist, wenn die Einfuhr des Wirkstoffs aus dem fraglichen Herstellungsbetrieb
nicht zugelassen wird. Aber auch dann muss die Qualität des Wirkstoffs sicherge-
stellt sein. Die Kriterien die bei einer solchen Einfuhrmöglichkeit einzuhalten sind,
werden zwischen Bundesministerium und den Bundesländern abgestimmt.

AESGP walked the Commission through the presentation (enclosed below) explaining the issue at play
with APIX, the consequences of a ‘rigid’ application of the EMA Q&A 2007 and the proposal for
solution. APIC explained the consequences for API suppliers of the upgrade from GMP Part II to GMP
Part I – the major consequence being the need to have a QP.
The Commission understood and agreed that due to stability and safety reasons, APIX should still be
considered as API, and not as first step in the manufacturing of the finished product. However, in their
view, there was not much justification for APIX on the basis of ‘handling’ or ‘workability’. They were
reluctant to open the Q&A too widely by fear of misuse of the exceptions by the industry.
It appeared that this was the main reason for the creation of this Q&A: to bring more ‘clarity’ into the
system and prevent that companies misuse/abuse the system and use GMP Part II when they should
really use GMP Part I.
The Commission committed to raise this at their meeting today with the inspectorates’ representatives
and to discuss a proposed revision to the Q&A with the EMA Quality Working Party (their next
meeting is on 17-19 September). Industry pressed the Commission for a prompt resolution of the issue
as companies are at a critical time point where they have to decide what to do with APIX-containing
products. Indeed, in some countries, regulatory applications are simply blocked because they concern
APIX. AESGP made it clear that this had not been raised at the QWP-IP meeting on 15 May because it
had already done so and was advised by QWP to specifically address the issue to the Commission.
Industry also asked that the Commission help to unblock the current situation and strongly encourage
Member States to review the justification of pending applications containing APIX, as currently is the
case in some countries. It is important that the evaluation of applications remains ongoing and that
assessors take sound decisions.
EFPIA also stressed that while the concept of Q&A is in principle welcome, it is important that these
are developed in a collaborative manner with all parties so that they help in promoting better and
consistent implementation of the legislation but not applied rigidly.

MEDICINAL PRODUCTS FOR HUMAN USE

INTRODUCTION
1. On 1 July 2011, Directive 2011/62/EU of the European Parliament and of the
Council of 8 June 2011 amending Directive 2001/83/EC on the Community code
relating to medicinal products for human use, as regards the prevention of the entry
into the legal supply chain of falsified medicinal products was published.1 This
Directive amends Directive 2001/83/EC on the Community Code relating to
medicinal products for human use.2
2. Directive 2011/62/EU introduces EU-wide rules for the importation of active
substances:3 According to Article 46b(2) of Directive 2001/83/EC, active
substances shall only be imported if, inter alia, the active substances are
accompanied by a written confirmation from the competent authority of the
exporting third country which, as regards the plant manufacturing the exported
active substance, confirms that the standards of good manufacturing practice and
control of the plant are equivalent to those in the Union.
3. The requirement of a written confirmation is waived for third countries listed by the
Commission in accordance with Article 111b of Directive 2001/83/EC.
4. To be listed, the Commission shall, at the request of the third country, assess
whether the regulatory framework applicable to active substances and the
respective control and enforcement activities in the third country ensure a level of
protection of public health equivalent to that of the Union (hereinafter: 'the
equivalence assessment').4
5. If the assessment confirms equivalence, the Commission shall adopt a decision to
include the third country in a list.5
6. In the equivalence assessment particular account shall be taken of:
• the country's rules for good manufacturing practice (GMP);
• the regularity of inspections to verify compliance with GMP;
• the effectiveness of enforcement of GMP;

• the regularity and rapidity of information provided by the third country relating
to non-compliant producers of active substances.
7. Article 111b(2) of Directive 2001/83/EC provides that the Commission adopts an
implementing measure to apply these requirements.
8. This concept paper is being rolled out for public consultation with a view to
preparing this implementing act.
9. The adoption of the implementing act is scheduled for 2013.
CONSULTATION TOPICS
1. EQUIVALENCE ASSESSMENT OF THE RULES FOR GMP
10. Article 111b(1)(a) of Directive 2001/83/EC obliges the Commission, in its
equivalent assessment, to take particular account of the third country's rules for
GMP.
11. In this context, and pending the adoption of a delegated act on the principles and
guidelines of good manufacturing practice for active substances6, the EU rules to be
taken into account are contained in Part II of the good manufacturing practice
guideline of the EU (Eudralex Volume 4).7

2. EQUIVALENCE ASSESSMENT OF THE REGULARITY OF INSPECTIONS TO VERIFY
COMPLIANCE WITH GMP AND THE EFFECTIVENESS OF ENFORCEMENT OF GMP
12. Article 111b(1)(b) of Directive 2001/83/EC obliges the Commission, in its
equivalence assessment, to take particular account of
• the regularity of inspections to verify compliance with GMP; and
• the effectiveness of enforcement of GMP.
13. In the equivalence assessment, the regulatory framework for inspections of
manufacturing plants of active substances is taken into account. This regulatory
framework is set out in Article 52a(4) and Article 111(1b) of Directive 2001/83/EC.
14. Moreover, regarding the risk-based approach provided for in Article 111(1b) of
Directive 2001/83/EC, the applicable rules are set out in the 'Compilation of
Community Procedures, Procedures related to GMP inspections – guidance on

occasions when it is appropriate for competent authorities to conduct inspections at
the premises of manufacturers of active substances used as starting materials'.8
15. To facilitate the equivalence assessment, points 1-9 and 11 of the audit checklist in
the Annex to this concept paper could be used. This audit checklist is used in the

Agencies ('HMA'), the European Medicines Agency ('the Agency') and the
GMP/GDP inspectors working group.10

3. REGULARITY AND RAPIDITY OF INFORMATION PROVIDED BY THE THIRD
COUNTRY RELATING TO NON-COMPLIANT PRODUCERS OF ACTIVE SUBSTANCES
16. The objective of this requirement is to make sure that the Member States in the
European Union are timely informed of possible quality incidents which occur in
the third country, as these may have an impact on the quality of medicinal products
placed on the EU market.
17. To ensure equivalence, it could be considered that the third country
• participates in and contributes to the 'Community information and rapid alert
system';11 and
• communicates any suspension or withdrawal of an authorisation granted, based
on non-compliance with GMP, to the EU.

• a review of relevant documentation;
• an on-site review of the third country's regulatory system, unless a mutual
recognition agreement ('MRA') is in place that covers the manufacturing of
active substances; and
• if necessary, an observed inspection of one or more of the third country's
manufacturing sites for active substances.
4.2. Interface with existing mechanisms
19. The Commission performs the assessment and verification of equivalence in
cooperation with the Agency and the Member States.12
20. In this context, in order to avoid unnecessary duplication of work, and in order to
build on existing mechanisms and expertise, it is intended to take into consideration,
where available and appropriate, the following:
• MRAs on GMP for medicinal products which cover also the manufacturing of
active substances;
• Regulatory alignment with applicable guidance of the International Conference
on Harmonisation of Technical Requirements for Registration of
Pharmaceuticals for Human Use ('ICH');13
• Existing assessment programs such as
– The Joint Audit Programme used for assessing European Union’s
authorities and MRA partners; and
– The Assessment and Reassessment Programmes of the Pharmaceutical
Inspection Convention and Pharmaceutical Inspection Co-operation
Scheme ('PIC/S').14
4.3. Regular verification
21. According to the Article 111b(3) of Directive 2001/83/EC, the Commission shall
verify regularly whether the conditions of the GMP equivalence are fulfilled. The
first verification shall take place no later than three years after the country has been
included in the list.
4.4. Date of application
22. The rules on importation of active substances apply as of 2 July 2013.15

1. Rechtsgrundlage
Der Gemeinsame Bundesausschuss (G-BA) hat nach § 31 Abs. 1 Satz 2 und 3 SGB V in
den Richtlinien nach § 92 Abs. 1 Satz 2 Nr. 6 festzulegen, in welchen medizinisch
notwendigen Fällen Stoffe und Zubereitungen aus Stoffen, die als Medizinprodukte nach § 3
Nr. 1 oder 2 des Medizinproduktegesetzes (MPG) zur Anwendung am oder im menschlichen
Körper bestimmt sind, ausnahmsweise in die Arzneimittelversorgung einbezogen werden.
§ 34 Abs. 1 Satz 5, 7 und 8 sowie Abs. 6 und die §§ 35, 126 und 127 SGB V gelten
entsprechend. Für verschreibungspflichtige und nicht verschreibungspflichtige
Medizinprodukte nach § 31 Abs. 1 Satz 2 SGB V gilt § 34 Abs. 1 Satz 6 entsprechend.
Der Gemeinsame Bundesausschuss hat die medizinisch notwendigen Fälle in § 29
Arzneimittel-Richtlinie (AM-RL) wie folgt konkretisiert:
Ein Medizinprodukt ist medizinisch notwendig im Sinne des § 31 Abs. 1 Satz 2 SGB V wenn,
1. es entsprechend seiner Zweckbestimmung nach Art und Ausmaß der Zweckerzielung
zur Krankenbehandlung im Sinne des § 27 Abs. 1 Satz 1 SGB V und § 28 geeignet
ist,
2. eine diagnostische oder therapeutische Interventionsbedürftigkeit besteht,
3. der diagnostische oder therapeutische Nutzen dem allgemein anerkannten Stand der
medizinischen Erkenntnisse entspricht und
4. eine andere, zweckmäßigere Behandlungsmöglichkeit nicht verfügbar ist.
Nach § 31 Abs. 1 Satz 2 2. Halbsatz i. V. m. § 34 Abs. 6 SGB V können Hersteller von
Medizinprodukten beim Gemeinsamen Bundesausschuss Anträge zur Aufnahme von
Medizinprodukten in die Anlage V der Arzneimittel-Richtlinie (Übersicht der
verordnungsfähigen Medizinprodukte) stellen.
Der Gemeinsame Bundesausschuss hat ausreichend begründete Anträge innerhalb von 90
Tagen zu bescheiden.
Nach 4. Kapitel § 41 Abs. 3 Satz 1 der Verfahrensordnung des Gemeinsamen Bundes-
ausschusses (VerfO) sind Änderungen der Angaben gemäß § 41 Abs. 2 dem Gemeinsamen
Bundesausschuss unverzüglich mitzuteilen.
2. Eckpunkte der Entscheidung
Vor dem Hintergrund der Konkretisierung der medizinisch notwendigen Fälle in § 29
Arzneimittel-Richtlinie und unter Berücksichtigung der vom Antragsteller eingereichten
Unterlagen hat der Gemeinsame Bundesausschuss beschlossen, folgendes Medizinprodukt
in die Anlage V der Arzneimittel-Richtlinie gemäß § 31 Abs. 1 Satz 2 und 3 i. V. m § 92
Abs. 1 Satz 2 Nr. 6 SGB V nach Maßgabe der in der Anlage V der Arzneimittel-Richtlinie
genannten Regelungen aufzunehmen:
„ParkoLax®“
3. Bürokratiekostenermittlung
Durch den vorgesehenen Beschluss entstehen keine neuen bzw. geänderten
Informationspflichten für Leistungserbringer im Sinne von Anlage II zum 1. Kapitel VerfO und
dementsprechend keine Bürokratiekosten.

4. Verfahrensablauf
Bei der Geschäftsstelle des Gemeinsamen Bundesausschusses eingehende Anträge
werden im Unterausschuss Arzneimittel sowie in der vom Unterausschuss eingesetzten
Arbeitsgruppe Medizinprodukte beraten.
Der Unterausschuss Arzneimittel empfiehlt dem Gemeinsamen Bundesausschuss,
antragsbezogen die Aufnahme von Medizinprodukten in die Anlage V der Arzneimittel-
Richtlinie nach Maßgabe entsprechender Regelungen.

equivalent to that in the Union

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European
Union,
Having regard to Directive 2001/83/EC of the European
Parliament and of the Council of 6 November 2001 on the
Community Code relating to medicinal products for human
use ( 1 ), and in particular Article 111b(1) thereof,
Whereas:
(1) In accordance with Article 111b(1) of Directive
2001/83/EC a third country may request the
Commission to assess whether its regulatory framework
applicable to active substances exported to the Union
and the respective control and enforcement activities
ensure a level of protection of public health equivalent
to that of the Union in order to be included in a list of
third countries ensuring an equivalent level of protection
of public health.
(2) The United States of America requested, by letter dated
17 January 2013, to be listed in accordance with
Article 111b(1) of Directive 2001/83/EC. The equiv
alence assessment by the Commission confirmed that
the requirements of that Article were fulfilled.
(3) Commission Implementing Decision 2012/715/EU of
22 November 2012 establishing a list of third
countries with a regulatory framework applicable to
active substances for medicinal products for human use
and the respective control and enforcement activities
ensuring a level of protection of public health equivalent
to that in the Union, in accordance with Directive
2001/83/EC of the European Parliament and of the
Council ( 2 ) should be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
The Annex to Implementing Decision 2012/715/EU is replaced
by the text set out in the Annex to this Decision.
Article 2
This Decision shall enter into force on the fifth day following
that of its publication in the Official Journal of the European
Union.
